I know Dan Mcdowell personally.  He was the inspector when I was a super in Hutto for Lennar.  All Dan needed was a bottle of his favorite drink or a small kick back and green tags flew out the window of his truck.  On many occasions all we ghad to say is "oh come on Dan you know Ill get it done" and boom there you go a green tag.  Very rarely did Dan come back to reinspect homes,  Even if he did fail it.  All you had to do was tell Dan what he wanted to hear and you got your tag.  At the time he was doing contract work for Hutto and then doing inspections for other builders.  So he really didint want to have to come back to Hutto later in the day so he would just pass it.

I HAVE A CRACK THAT RUNS DOWN THE MIDDLE OF MY HOUSE PARALELL WITH THE STREET. IT BULGES GLUEDOWN ENGINEERED HARDWOOD FLOORS AND CRACKS TILE ALONG ITS PATH. I NOTICE THE ORIGIN WHEN THE HOUSE WAS BEING CONSTRUCTED IT STARTED IN THE CENTER OF THE HOUSES AND WENT DOWN BOTH SIDES. I HAVE A POST-TENSIONED FOUNDATION SYSTEM AND HAVE HAD THE COMPANY ENGINEER COME OUT TO INSPECT (BY INSPECTING I MEAN SWINGING DOORS AND LOOKING FOR SURFACE CRACKS IN THE GYPSUM.) THEY DID ISSUE A LETTER AND SAY NOTHING WAS WRONG WITH THE FOUNDATION AND TO CALL IF THE CRACK GOT BIGGER. I DON'T BELIEVE THE COMPANY OR THE COMPANY ENGINEER IS WORKING IN THE BEST INTREST OF MY FAMILY AND I DON'T HAVE THE MONEY TO HIRE AN INDEPENDANT ENGINEER OR ORDER A GETECHNICAL REPORT ON MY LOT.

COULD YOU PLEASE HELP MY FAMILY RESOLVE THIS SITUATION.

Description of Complaint 

We purchased our home from Lennar as noted above. The first time a north wind blew in on 11/15/05 at apporximately 35-40 MPH we heard strange noises coming from the attic. The following day, we observed numerous cracks and numerous nail pops located where the walls met the ceilings through out the house. We contacted Lennar who sent out their engineer and others. Over the next several months they sent subcontractors to place a "scab" that Lennar claimed should have been in place according to the blue prints of the house, but in fact it had not been installed. They then installed it and assured us that this would prevent any further cracks or cracking. During the time we were waiting for Lennar's people to come put in the scab and fix the cracks and nail pops, several individuals who came to service other items we had purchased, came and inquired why we had "blue tags" throught the ceiling in the house. We advised them about what had happened. Now, these people did not know us and had no affiliation with Lennar. They asked how old the house was and we advised 2-3 months. They just nodded their heads negatively and stated that these types of problems should not have been occurring in a house this new and that if we were having these types of problems, we had "framing problems." When we inquired as to why they would make this statement, they advised us they had previously been in the house framing business for over 20 years and that this type of cracking only occurred due to "framing problems."

Lennar sent its people out to fix and replace the scab, the cracks and nail pops. This was done by mid-January. (Please note that right before they made the repairs, we had 113 cracks in the house except in the pantry and master bedroom closet.)

The next time the wind blew (right after they made the repairs) we again heard noises in the attic. Several days later we checked the house again....and guess what we now had the same cracks appear where the previous cracks wee but now had cracks in areas that had not been affected before. We now currently have over 300 cracks in our home including the master closet and pantry.

Additionally the exterior of the house also suffered damage from the wind because Lennar later discovered that the prefabricated wood trusses that had been installed to support the roof (which were inspected by the engineers who devise them) had determined according to their report that there were several support beams that had either not been installed or had been installed incorrectly. This caused the top of the house to move which caused structural issues to our home.

In Texas homeowners are disadvantaged because of recent legislation in 2000 that allows a homeowner to sue home bulders for defective homes but we as homeowners must jump through several legal loopholes in order to get to the process of a lawsuit. Yes we signed an arbitration agreement but all of this is past the point of ridiculous. WE have had to hire an attorney who is well versed in this new Texas statute and is now dealing with the Lennar lawyers.

Two weeks ago the truss manufacturer came and made repairs to the trusses that were defective. WE are now waiting for Lennar to provide us with a plan as to how they are going to make repairs to the home that includes about 25 items.

OR LET YOUR FRIENDS OR FAMILY PURCHASE A LENNAR HOME!!!!!!!!!!!!!!!!!!!!!!!!!!

Location of house-2040 Nottingham Place,Allen,Tx. 75013
The house was the model home and office for Lennar homes in the Custer Hill Estate subdivision. It was built in 1997, but we were the first owners in 2001 (we bought it when they closed out the subdivision). The house was landscaped by the company. The street is on a hill and each lot is terraced. We lived in the house for one year before I was transfered to Houston. We lease the house now. In 2003, the house had cracks, through the tile and sheetrock, directly through the middle of the house. Lennar sent their engineer out and said the foundation had shifted due to the Oak tree that was planted in front of the house. The oak is on the same side of the house that the dirt was terraced up to level the lot. Lennar claimed that it was the oak that caused the movement, put in root barriers and said the problem would be over. The house has cracked 2 more times in the last 2 years. Lennar sent out a structural engineer, who claims that there is no damage to the slab. They cosmetically fixed the cracks, but the cracks have returned. The crack goes right through the center of the house (from the door frame, ceramic tile, sheetrock, to the back patio slab). We are in the process of hiring our own Structural Engineer to assess the problem. Lennar told us that they were done fooling with it, that this happens all the time in Dallas. I realize it is a common problem in Texas, but to happen as often and continually like it has, something else has to be going on. We were told to water, and we have. We asked them to remove the tree, they said the root barriers would work. We have a 10 year warranty on the foundation. We just want it fixed. The lot is small, as most are in that area. The house is shifting on the side that they built up to terrace the lot to build on the hill. I havent contacted a lawyer yet. We are waiting on the 2nd opinion by an outside engineer. I just want it fixed so that it doesnt keep cracking every year. What if the lot built up by Lennar is not capable of maintaining the weight of the house? What if there are structural problems in the building of the house? Should I expect Lennar to honor the warranty? They claim there is no damage. Why does it continue to crack? Am I justified in my complaint?

If you care, you will thoughtfully read this email and hopefully, for the first time since my dealings with Lennar I can get the needed help I so desperately seek. I closed on my home last June 2006 and have had nothing but problems from day one. I gave Lennar the chance to take care of these problems over and over again and all that I have gotten are excuses, empty promises and flat out lies from Lennar. I truly wanted to believe that my wife and I had purchased a quality home from Lennar, as that is what was promised. I was naive for the past ten months, but no more. I now know the truth that Lennar has known all along. Beyond all of the problems from the substandard construction that has taken place by Lennar.
Please, let me tell you a little story. On the day of my "walk through" at my home in Highland Park North Pflugerville Texas, I was standing in the house looking out the window into the backyard and there was a pool of water about five feet from the house, the customer care rep said don’t worry we will take care of it to this date the problem has not been taken care of as well as cracked ceilings and tile and sub flooring that is uneven I don't know what I was thinking, but I trusted that Lennar was handling all matters appropriately. I couldn't imagine that a builder of this size would not do everything in their power to construct nothing but the finest homes with so much to lose if they didn't. Well, I could not have been more wrong. There are SERIOUS problems that Lennar IS aware of and now so am I. There were MANY outstanding problems from doors that when the wind blows the doors sings, to drainage problems etc.etc....... Again, I was naive in believing Lennar that if I closed on this home at the scheduled time, they would have the problems taken care of before the end of that week. Ten months later, the work was still not taken care of. My phone calls were never returned and if they were I was told to call someone else I could go on and on!!! And it is not an isolated problem my neighbors are having the same problems as well.
One thing that I would like to make VERY clear. This has EVERYTHING to do with principle and my and my wife’s legal rights!!!!!!!!!
I am now ready to do whatever needs to be done to end this nightmare that my wife and I are involved in with Lennar.

Before the warranty ran out they came out to fix the fence 3 times,to make level and to add support posts,replaced rotten boards(the fence was less than 6 mths old).They have been out here numerous times to fill cracks in the corners and the ceilings, and the nail pops upstairs,floor pops upstairs,and they are still there. Weak decking for floors, we also had nails pulling out of the siding on house they came out and hammered every nail back in and painted just the nails,and now we have streaks. There are cracks in the concrete by the front door. We had a floor pop fixed but messed up the carpet and put 2 seams less than a foot apart from each other in front of the master bedroom in the hallway, they ended up taking the closet carpet and cutting it to fix the mistake and you still see the seam. They also had to replace all the banisters because of nails which you can still see, they put the wrong paint on one of them and now it is ruined . And all of my windows leak when it rains or gets cold out.they have had to come out to put extra dirt by the driveway because there was gap in between the driveway and yard. My kitchen cabinets are showing spots after the final staining and they gave me a can of laquer and told me to do it .When they fixed my carpet they left a nail sticking up which sliced my foot,and another time they were fixing my backdoor which had a crack in the frame and left a razor blade on the floor and I found my 4 year old playing with it..We have gone thru the right channels to have these problems fixed and nothing gets done and we get the run around even from the managers in the Austin office..

free floating trusses attached to the sheet rock, nails popping out,mold in the window seals,bathroom cabinets not secured and sagging, sinks set uneven,hot spots all over the house, carpet all troughout the house is loose and wavy, beams in the attic are splitting and i am sure there is alot more that we have not even found yet. they expect us to either live in a plastic bubble while they fix the problem or live in a hotel with our two kids and my wifes parents, neither of which is acceptable.we are in the process of locating an attory so that we can see if we have grounds for a lawsuit for purchasing a defective home.
