Houston homebuilder Bob Perry has his favorite in the Texas governor's race - incumbent Rick Perry (no relation). The Republican governor has been a long-time recipient of campaign cash, and has reciprocated by creating a state agency that protected builders from consumer complaints (now disbanded after a storm of protest). Perhaps the nation's most prolific campaign giver, Bob Perry, ...in Texas, the homebuilder is an advocate of having the government limit lawsuits against business, including his own. At the same time, he's refused to pay court judgments against him. A jury in Fort Worth ordered him to pay $58 million to a retirement-age couple for refusing for a decade of fix their defective home. Background: This started in 1994 with a doundation failure. The jury ruled in favor of the homeowner. The appeal court did too. The Supreme Court did too. The builders then tried to change the law by filing Texas Senate Bill SB623 which did not pass. Now the Supreme Court has ruled again, deniying Perry's request for a review.. All over $2800. May 13, 2001 Posted to the Perry Homes Page: Perry Homes v. Alwattari NO. 2-98-106-CV. This was provided as support for Texas Senate Bill 623 (see below) which would provide more protection to the homebuilders. Perry offered to pay 60% of the cost to the foundation with the owner paying the other 40% ($2800) and filing with the Home Owners Warranty. HOW is in recievership, and the owner could only get reimbursed if there is money and if there is a valid claim. This entire suit going through the appeals process and landing in the Senate was all about just $2800.00.
Mar 30 2001: Testimony heard for Texas Senate Bill SB623 Randy Birdwell, CEO of Emerald Homes (July 19, 2001 aquired by DR Horton) spoke in favor of the bill. This bill would provide more protection to builders even if a reasonable offer was not provided prior to a suit (arbitration). Others who testified include:
