Grand Home Busted - Illegal Real Estate Settlement and Referra/kick-backs Charges

Grand Homes in Trouble
Law enforcement officials have just confirmed that a HUD/RESPA complaint filed by certain Richardson Residents involving locally-based Grand Texas Homes, Inc. (GRAND) and its captive builder-controlled title company, Grand Title Company, LLC (GTC) involving illegal real estate settlement-related practices was successful. The complaint and ensuing investigation focused on selling, marketing, affiliated business disclosures, required title service provider practices and sales agreement provisions, and related business referral/kick-backs involving federally-related mortgage transactions associated with the Enclave of Breckinridge development in northeast Richardson. As the lead HUD/RESPA investigator in Washington, D.C. remarked when critical additional documents were provided by the two lead complainants, “YOU’VE MADE OUR CASE.”

Legend Home: Biggest Mistake in My Life

This was the biggest mistake and the worse investment I have ever made in my life!
Now I am stuck with a new home that is a piece of junk and I am condemned to a life of debt and a home I will never be able to sell. After 1 year, the entire house started cracking in half. There were large cracks in the brick, the sheetrock, the drywall, the windows, and the hardy plank. The house sustained major structural damage and serious foundation problems.

Legend Homes New Home falling down in 5 yrs due to poor workmanship and foundation Houston Texas
Our home has shifted almost 4', the brick is cracked, water is coming in all the windows, our attic has shifted, walls are cracked, windows are cracked, shingles are coming off our roof, roof is buckled, electrical has been pulled loose from the wall with loss of electric and shifting, toilet drainage is going up instead of down and numerous other issues. Our house is suppose to have a warranty of which is no value. Warranty company does not want to work with us or fix the problems. The state of Texas TRCC has given us a favorable ruling with the builder Legend Homes.  Legend Homes says they are not at fault and it is strictly a warranty issues and they are not responsible.

Legend Homes files bankruptcy

Oregon home builder files for bankruptcy
1 of Oregon's largest home builders has filed for bankruptcy after its parent company made some bad land investments. Legend Homes' chief executive officer, David Oringdulph, says ill-timed purchases made in the once hot areas of Bend, Vancouver, Washington and Southern California prompted the bankruptcy.

Homeowners increasingly face builder damages, neglect
"There was defective caulking, large gaps in the bricks, the tub wasn't working properly, cracks in the ceiling and the dining room, water intrusion in the walls...," Kushner said. "Even my garage door wasn't installed properly and every time the wind blew, it would cause the security alarm to go off. I had to have someone come out and fix that problem. It was horrible." A closer inspection would reveal nearly every family heirloom and assorted clothing and shoes stored in her closet had fallen apart, leaving Kushner clueless as to the cause...Kushner has presented her case, from the Harris County Appraisal District to Rep. Corbin Van Arsdale to members of the statehouse all the way to Gov. Rick Perry.

BBB Looking at Growing Trend of Defective Homes

...BBB statistic claiming for every one complaint the organization receives, there are twenty problems never reported...From KB Homes to David Weekley to Royce and Perry, Parsons said the growing trend in building new, damaged and defective homes, however, is a problem which the BBB is looking at..."Something very bad is going on and for the first time, I am starting to wonder whether we are going to be able to keep homebuilders as members," Parsons said... In 2003, after homebuilders successfully lobbied the state legislator for a new state agency to protect them against lawsuits, the Texas Residential Construction Commission (TRCC) was formed. Since the TRCC's inception, Parsons said nothing but problems and issues arose..."Our mandate on the TRCC is that it is the law, but it is not a good law. We don't like laws like this; we want businesses to play fair."... "Half the builders hate that law. They saw some of the zealots start to affect their industry, not because they were bad but because other builders were bad," Parsons said. Furthermore, Parsons said the TRCC hurts the good builders left in the industry. "It is a terrible law. It is interesting that you look at the homebuilders who backed the TRCC law have gone south with us-Weekley, Royce and Perry."
