dr horton south carolina--lack of communication-one lawyer serving both the seller and buyer-not a good idea for buyer(beleave Me)
trying to get the house has been a nightmare-seeing all the complaints is making it worse-threats of keeping our ernest money and charging us 250.00 a day till something is resolved,has but us on the verge of a nervous breakdown

It has been a very distressing experience throughout the post-sales customer service of our newly purchased RYLAND home located in the newly constructed Trails of Bentwood Ranch subdivision. It appears to have been two TOTALLY different companies compared to the superior pre-sales support and experience! Just a week ago, my wife and I were touted as “golden candidates” based on our exemplary credit scores, careers and salaries, advanced degrees, and the like. We actually qualified for ALL of the RYLAND pre-purchase incentives (No Money Down, No Payment until June 2006, and $1000 Best Buy Gift Card) – upon which our loan officer and sales associate advised that they’d ‘never seen anyone qualify for ALL three!”. We were quite satisfied with our pre-sales experience and looking forward to spending quality family time in our new environment!

What a difference a week makes?! Less than 24-hours upon closing Friday, April 14, 2006, 9am, on the Charleston model home ($294K), we’ve have experienced nothing that has even remotely resembled our pre-sales experience! For in that short week, the superior customer service and support has turned into:
Inadequate, non-proactive customer service
Inadequate quality assurance, workmanship, and craftsmanship
Unsatisfactory customer resolution
Mis-management and decision making by Ryland ‘tenured’ associates
Blatant lies provided by Ryland representatives
My personal character and integrity being challenged and called into question

My initial correspondence to Ryland corporate management, in particular to Mr. Ross Benline, had been ignored and non-responsive; however, I have confidence and hope that indeed Ryland’s top leadership will confirm and address our documented dissatisfaction(s) and do the right thing to ensure customer satisfaction based on the root cause being the fault (as admitted to by both Mr. Ross Benline and Mr. Jeff Snyder) of Ryland’s and the vendor plumbing company, Gibson’s, inept quality assurance, workmanship on this particular home.

I have attached all previous documented correspondence (per Ryland’s warranty process) to our continued dissatisfaction with how our home buying experience has basically been a nightmare. I look forward to your expeditious attention and resolution to this matter.

How long will the dryers be in the home? I was merely looking for a time-line of the scheduled repairs. He had none.

I also inquired as to how does Ryland compensate new home buyers for situations such as this, where the root problem is the fault of the builder and the subcontracting company.

RYLAND conducting an assessment of the damaged area. At this time the home still had the 6 deafening industrial blowers and humidifiers. Eric from the water extraction company was also on the scene. He offered to reimburse my family for dinner.
The sheet rock specialists also felt it necessary to quarantine the area with protective plastic, not done nor recommended by Ryland’s specialist. AND to add insult to injury, making the matters worse, this sub-contractor company of RYLAND caused more damage to our home. The damage with cracking or severely scratching approximately 15-20 ceramic tiles in the home. When I advised Nicholas to add these repairs to the work order, I was confronted that “no, no. these scratches were already here Sir.
No protective tarp was placed in the work areas or paths to the work areas.

This was the 7th day since my initial engagement of the major plumbing issue caused by the builder’s inadequate quality assurance process for removing ‘test balls’ from the new home construction prior to customer closing. I identified myself as a recent Ryland home-buyer, and most dissatisfied customer, to the receptionist and requested to speak with ‘the decision maker who can make things happen’.

...having only been in the home for less than a day before a major plumbing issue resulted in: 1)Backup of two upstairs bathrooms; 2) Leakage through my downstairs kitchen ceiling; 3)Inadequate responsiveness...

Myself and 3 friends are under contract to purchase a Lennar townhome in the Bella Terra subdivision in Estero, Florida. We all signed contracts in August of 2005. Since that time the market has experienced a slowing down and oversupply. Lennar has offered numerous incentives since August including- $10,000 off of closing costs, generous broker bonuses, free pool ($30,000 value) and finally constant price reductions on the base price. We are now at least $50,000 upside down on what the same townhomes are selling for now and decided not to close this month. We are looking for others in this same situation. I have sent a certified letter to the SW sales manager and am awaiting a reply. We have asked for our money back and they have verbally refused. Our contract forced us to arbitration but after reading the disastrous results this does not seem like a good solution. We cannot get out on the mortgage contingency since they have the right to force everyone through their mortgage company Universal and do a biased appraisal. Any suggestions would be greatly appreciated.

When I purchased my home from Centex my escrow was miscalculated. This caused my mortgage payment to rise $300 a month. I am currently in the process of trying to get this issue addressed as well as some warranty issues. If you have any information or contact information that might be useful it would be greatly appreciated. Thanks

have a contractor (American Pride Builders) who, after 4 1/2 months,
has not even pulled a building permit for our new home. This person is impossible to deal with and has no interest in communicating with us. He has lied and failed to follow up on a single promise.

I know it all sounds petty at this point, however I have found another
customer who has been waiting almost a year without the first brick
being laid-down and has already been invoiced and EXTRA 10% of his
orginal price PLUS $21,000.

1. Permitting issues

AP Builders told me that the permitting process takes 4 to 6 months in Lee Co, Fl. I work for a builder and when I spoke with the person in our office that is responsible for pulling permits, he informed me that we get permits on our custom homes in 10 days when he pushes it and no longer than four weeks if he does not. He even stated that when we have a septic system that the very longest we take for all approvals is 12 weeks.

I asked our realtor to see what she could find out about the process from her builders, it appears that one of her associates, from Dynasty Builders, takes 5 days to pull a permit that has a master plan on file and, one to three weeks if that plan requires revisions. He works in the specific area that I am building....

We were told that there was $5000 allowance in our contract for permits, but at closing we were informed that the permitting fees are $7400. If they know this then why in the world would they only allow $5000 up front? To be hit with a $2400 extra before we even got up from the settlement table did not leave a good taste in our mouths.

2. Issues with your sales staff,

Matthew, our salesman, telephoned me with concern that my Realtor was not living up to her end of the bargain and he did not feel that he should pay her. I asked her to call Matthew and when he spoke to her he denied ever telling me that.

During the conversation that Matthew had with my Realtor (in item 1 above), he informed her that APB did not even have a signed contract from me. The fact of the matter is that he has received three signed contracts from me, each one within a day of it's receipt. I have email traffic to prove the last two as well as our original signed document.

During that very same conversation Matthew explained to my Realtor, that the schedule was delayed due to permitting issues and that we were looking at 12 months from closing to be in our house

During our initial visit to the model, where we plunked down our cash, we were told that the process took 9-10 months from closing

When we visited the model , December 27, 2005, Matthew told us that he had informed me that the wall changes we had requested would delay the schedule several months and that we were looking at 14 to 16 months. A schedule delay was never discussed. The day we signed our original contract we were informed by Matthew that non-structural wall changes would be done with little or no cost and schedule impact.



After speaking with the owner of the company, Sal Allen, I have been told that the process takes 14 to 18 months... SO which is it?


These contractors have not returned a single phone call nor have they sent out the monthly progress reports as promised. They refuse to give me any information with regard to progress and process. They have been rude and arrogant.

Builder: Raptor Construction/Ben Ignatuk
Unaccountable use of installment payments made to the builder.
Subcontractors placing liens on the consruction of the house. Breech of contract:down payment recieved by builder 25,ooo,with final payment upon completion. But builder was given installent payments total 277,00 by homeowner to proceede with building the house in timely fashion. Builder is demanding more money without producing proof of waivers, payments to subcontractors, and has stopped construction in the midst of leaving the house unsecured and accessable to damage.

On April the 15th 2005 my husband and I closed on our new home. We did not have it built. We went through a realtor Dawn Osif out of Iron gate Realty Company. We have had problems from the on set with this house, but the builders, Improved Solutions for Urban Systems(ISUS) have vertually remained no compliant. In the first two weeks our kitchen begain to flood. We called the, they came out and, they had to call rotor Rooter, which pulled out about six tampons, and tore up at least two snake heads in the process, but they we unable to fix the problem. So ISUS then called the city of Dayton to come out, and they had to dig up the street to fix the problem. Then ISUS tried to bill my husband and I for the money, I refused to pay them. I took picyures of the tampons which were extracted from the drain. The floors are not level any where in the house, the lanolium tore in the dinning roon area with in 3 months,the steps sqeak, the master bed room floor squeak, the siding was never applied to the house properly, and has already started comming down. The porch, both the front and the back have big gashes in the cornor of the,they are both cement. The wall going up stairs is bowed. Most of the walls have blisters of some kind in them. The windows do not drain, allowing rain water to enter the home, the doors to all of the closets are bowed and cut to short. The kitchen sink is comming away from the wall. On or about January the 28th at about 10:55 P:M 3/4 of the electricty went out upstairs and still remains that way today. I have had to hire Reddy Electric company to come out and try to track down the problem. I had to hire Best Inspection Services, INC to come out and do anotherwhole house inspection on this house. I am at my wits ends, everyone I contact slams the door in my face. I need to know how to get this company to fix this house or take it back? The price started off at $111,900 and by the time everything was said and done we owe $130,000. ISUS told the B.B.B. that they build quality homes for at least $40,000 under their value. I have $37.00 worht of pictures I took and had developed. I have reports from Reddy Eletric Company, as well as Best Inspection Srevices, INC. I Just got a copy of my home warranity on March the 22nd 2006. We are faced with filing bankruptcy for something we did not do. My husband makes $10.35 an hour, plus he is semi retired, but his retirement money stopped in August. It was supposed to stop until December, and start back up in January, but we found out it won't start up again until July of 2006. I am disabled and can't work. My husband and I got married in March of 2005 and my disability was cut of that day. My husband James was getting $1,082 a month. We have no funds or means to hire attorneys. In February (19th-23rd) of this year my son had been admitted to the hospital for asthma and pneumonia. During that week my dog had been running around the dining room table and crashed into the wall. When he did, the wall crumbled. As the wall crumbled I noticed black mold in the drywall. Then when I moved my desk in my living room which had not been moved in over a year I noticed that that wall also had mold on it. I read over my home owner’s insurance policy and found that I did have mold coverage so I filed a claim with “American Modern Home Owners Insurance” on Monday February 27th and they told me that they would have an agent call me to set up a time to come to the home. I got the call on Tuesday Feb 28th and was told they would send someone out on Wednesday March 1st at 3pm. On March 1st the insurance person came to my home and she clearly saw the mold in the dining room and living room walls and even touched them and they broke off in her hand. Then she told me she was going to walk along the outside of the home and have a look as well as on the roof. After she did her walk around, she asked me to come outside. She told me that the cause of the mold was because of screw holes that were left in my siding from window flower boxes I had removed 7 years ago when I moved into the home because the previous owners were using them for ash trays. She told me she is denying the claim based on those findings and I should get a denial letter in the mail within a few days. Not happy with that answer I called on Thurs, Fri, Sat, and Mon to get a hold of her supervisor to try and have him come to my home. He finally called me back on Monday March 6th to tell me “no” he would not be coming to my home because he had already made his decision based on the agent who had already come out and the claim has been denied. So, then I called the Macomb County Health Dept to report the mold and was told they don’t come to residential homes. I thought that is what they did. I then called the township to look for help but again was told the same thing…they don’t come to residential homes. I next called every mold remediation company in the yellow pages to see what they could do for me and was told that it would cost me a couple hundred dollars to have someone come to my home just to tell me I have mold and then another couple hundred dollars to have a sample sent to their lab. As a single mother, I just don’t have that money available. I have also written a letter the Environmental Protection Agency to report the mold but I have never heard anything back. I have written letters to the Michigan Governor, State Rep, and the State Legislator but have not heard anything back. I have reported the insurance company to the Michigan Insurance Commissioners office but have yet to hear anything back. I have also written to the news stations Channel 2, 4, and 7 in the hopes of getting my story out there. I also called the Macomb Daily newspaper to get a story written regarding the insurance company not paying for the damage. The Macomb Daily did end up writing a story on March 30th page 3-A (Macomb Daily.com) and also channel 7 news did a story on March 30th (Wxyz.com) as well as WWJ news radio am950 doing a phone interview with me on March 30th. I have also written a report to “Rip-off-report.com” as well as HADD. After not hearing anything back from anyone and not being able to live in the home with my two children I was not left with any options so I chose to have the home torn down. The demolition did take place on March 23rd. Now unfortunally I am still left to pay on a mortgage for a home that I am not able to live in nor does it exist. I have spoke to my mortgage company Green Tree Financial on several occasions but they are not willing to give me any break or relief so I will have to continue to pay. As of right now, my children and I have been forced to live with friends until we are able to afford a place of our own. Can you help our family?
