This Houston based mega-development company is currently running the Sienna Plantation Homeowners Association (SPRAI a CAI affiliate). They have refused to allow at large elections for minority representation on our HOA board here. As a matter of fact only 3 board members exist and they are all employees of this company. They are also stacking some "resident committees" with paid employees and filtering heavily others that volunteer to serve. They have other communities in this region they have run the same way and it has spun off law-suits. This is the same company that initiated a SLAPP-suit to stifle petitioning efforts by local homeowners against certain land-use here (see http://www.fortbendnow.com/ />news/719/activist-slaps-back-in-countersuit-against-sienna-plantation-developer or http://missouricitychatter.blogspot.com/2006/05/new-home-builders-newsblogcom-reports.html ) which tripped a homeowner counter-suit (SLAPP-back) for Fraud, Trade Deception, Harassment & Negligence.

Hi,
I own a townhome in belmont country club - the greens built by toll brothers. I moved in to the home on november 2005 and didnt have a chance to test the airconditioning system till this summer. When I switched the airconditioning system on, it did not work. Given these circumstances, I believe toll brothers has been negligent in installing the airconditioning system at my home. I have my parents staying with me for this summer. They are very old and the heat and humidity inside the home due to the lack of a working airconditioning system has made them extremely uncomfortable. I am afraid it might impact their health.
I have attempted to resolve the issue with toll brothers and falcon heating and air conditioning(the air conditioning subcontractor) and they have not been able to resolve it for last 3 weeks. They havent provided me with a time frame when the issue will be resolved.
I wish to report this as a complaint against toll brothers.

Our CHOICE HOME, Fox Run Midlothian, TX closed on 2-24-06. Starting the day our home closed our property was heavily damaged by stormwater drainage from other lots in the development. There was a large pile of dirt left on the adjacent lot which ran across our property and caused what we felt to be extensive damage as it formed a gully. Our lot was not provided a temporary silt fence for protection as a few of the other houses in the development.
We were told by the forewoman of our house that Choice Homes realized they had a problem and would be constructing permanent retaining walls. Our neighbor was told the same. Then, Choice Homes refused the retaining wall and used a survey report to condone them not doing so. After many requests and complaints for a solution, (our neighbors were having problems as well), they finally placed berms on their three side property lots, including ours. The three lot berms were never watered and the dead sod is splitting and working its way down towards our property.
Choice Homes told us they would come in and repair the damage including the gully and replace our sod. We came home to find that instead they had constructed a deep, unsightly berm on the lot, leaving us no option for a fence. The gully was deepened. We requested for them to correct the damaged lot and they refused. We were forced to correct it ourselves and they covered it with sod. We are questioning the legality of the deception used to gain access to our property.
After we did this, Choice Home's attorney stated in a letter to the TRCC that we altered the drainage! They also failed to mention the side berms, an indication that they know of the drainage problems. The letter stated "Excluding what the -----'s have done to adversely affect the drainage, there are no problems with the -----'s home as constructed and graded by Choice Homes" They failed to mention that they had not had permission to construct on our property to begin with.
In addition, they had placed a silt fence one foot within our property line next to a berm for the purpose of retaining the adjacent property. We had to plumb for our fence and took their silt fence down, notifying them that it was on our property. We felt we should do this so they could place on their property, which they did. The letter stated that we had removed the silt fence from their property! Is this not slanderous? Fortunately, we have the photos to prove this.
Our pictures in the front clearly captured the flow of water and pooling in front of our foundation. Choice Homes filled with about 1 inch of dirt and a thicker sod for about 3 feet out. It is still improperly draining. They stated that, once again, their survey report indicated that it was properly draining. Choice Homes has outright refused to regrade the front. We placed sand bags along the front as we got tired watering by hand to control the drainage.
Since the drainage and pooling problem, other warranty requests we have made, such as the carpet, have been denied and we feel as though it is a direct result of our persistence in getting the drainage problem resolved.
We asked a top executive if Choice Homes was going to disclose the drainage problem to potential buyers of the other lots, and we were told that according to the plat, there are no drainage problems! We interpreted this as a clear "no". Some of our neighbors had been enduring drainage problems for quite some time.
With the exception of one, who has no answer to the problem, none of the execs are returning our calls, emails, or correspondence. My husband went to the corporate office in Arlington this morning....he was not allowed to enter the building due to the tight security. The receptionist refused to let him speak with anybody.
We are continuing to make further complaints and contacts. We definitely do NOT recommend Choice Homes. We feel the management has been basically inaccessible and some very serious warranty issued denied. Please feel free to contact for photos. |

My home was completed 2/26/2006
1. Water comes through the front door. 2. Toilet tank full, but runs water and do not stop. 3. Carpet is damage. 4. Screws expose in the walls in the bathroom. 5. Kitchen linoleum is lifting up. |

I contracted with Roger Smith dba Cornerstone Builders in Lake Jackson TX to build my dream home. Three months after we moved in we started noticing small cracks in the window casings. Then about a month later there were cracks in our walls and ceilings. There is a crack in our slab running from our garage through to the back patio. I diligently went through the TRCC process and they told me that the foundation was moving within its limits. Now they have instructed the builder to just make the problem fit the house and putty up the cracks in the walls and fill in the crack in the garage with epoxy. What alternatived do I have? |

Sun George Homes Courpus Christi. This builder has refused to repair the problems with my home. I have sent letters and pictures to the TRCC and to the BB no help. The one year warrenty that came with home is worthless Sun George says what, when and if he will do anything. If the one year warrenty is this bad the ten year is not worth the paper that its written on. WATCH OUT FOR SUN GEORGE HOMES. Tom |

My husband and I built a $300k home with Dominion Homes 1 year ago and it has been nothing but a headache with them. We (along with several other neighbors with Dominion Homes) have complained about our stucco cracking due to it not being put on properly and diluting the materials to save money. They have done nothing but dance around this issue and ignore all of us. Some of us have gotten attourneys involved to try to get this straightend out. BEWARE OF DOMINION HOMES!!!!! |

My home has electricity that continually trips and water drainage problem and landscaping issues due to the water drainage problem when it has rained. Also the home has low water pressure. Ryland installed a cheap version of a french drain system and routed the water though the back of the house into my neighbors and my yard instead of routing to the street. Ryland says that landscaping is homeowners poor maintenance. Landscaping problem is Ryland's faulty work. I have file complaint with BBB. My next step is the courthouse. |

American Pride Building Company, LLC, of Cape Coral, Florida Is NOT an Honest Contractor
In October of 2005 we visited American Prides Models and started the process of building our dream home in South West Florida. We selected a model and, on December 15, 2005, we gave them over $40,000 to get our home started. Well, the stories started changing almost immediately! First they would not take any calls or emails, when I finally contacted the owner, Sal Allen, I was hopeful that things would get moving and I would get some answers. No such luck, he is just as bad as his nephew, the salesman.
Pursuant to Florida Statute 489.126, he is obligated to apply for a permit in 30 days and start work in 90, as of 05-22-06 he has not done ANYTHING!
To make matters worse Mr. Allen has informed me that he has no intention of starting my house until I give him the difference between the price I paid at contract time and his current price, OVER $20,000! We do not have that kind of cash just sitting around even if I was inclinded to give it to him!!!!
AND, it's not over, he also intends to charge me the current price for permits and site work! He had access to my lot prior to our contract date, he knows what everything costs up front, but likes to rip people off. |

The Biggest Mistake...
The biggest mistake which you can make in purchasing a new house from a corporate/public new house builder is the assumption that you and your family will be happy home owners. Making this assumption is like setting yourself up to be blindsided while blindfolded.

The honoring of a new house warranty by some corporate/public new house builders is not much more than a sophisticated, subtle form of theft from people (new house buyers) who are victimized by the corporate/public new house building industry. Nothing more, nothing less. A spade is a spade. People are getting less than what they bargained for; free enterprise is free enterprise, theft is theft, nothing more, nothing less. |

I am a newlywed and we bought our first home 8 months ago in Texas. It is a DAVID WEEKLEY and is a lemon! We thought by buying a brand new home, we would encounter less problems---we were wrong! Here is what has happened thus far: 1. our downstairs--all of it--FLOODED. The plumbing in the 1/2 bath was clogged and erupted. Our hardwood floors were ruined, our carpet was ruined--they didn't want to replace the carpet, they finally did, rugs were ruined. 2. All of our door handles have fallen off--about every month! 3. Our bathtubs have been broken--hot water didn't come out of the guest bathroom and the master bath at different times. 4. There were dust bugs (of some sort) in our wood going up the stairs. They said they would replace it and when we got home to look to see if all the little holes were gone, we noticed they just PAINTED over them! What? They ended up telling us that they got shotty wood and didn't want to put it in until they got new wood--why not leave it w/o paint--why paint over it unless you want us to think it's finished so you don't have to fix it? They ended up telling me it was my fault for having antiques in my home--i don't have antiques on the stairs let alone the rest of the house--everything is new. 5. Our backyard is filled w/ water 70% of the time due to bad drainage--they refuse to fix it! 6. Our trees have died and they refused to replace them. 7. Our fence was broken in 2 places. Please be careful when buying a DAVID WEEKLEY! I am no longer a naive young girl when it comes to buying new homes--our home is not an inexpensive starter home, either---all these problems I might have expected in a cheaper home--I don't know, I'm at my wits end! I don't think they are taking time to build proper homes and then the people that buy them, live in them day in and day out, suffer! |
