THIS COMPLAINT IS ABOUT JIM WALTER HOMES IN HAMMOND LA WE WERE TENDER THIS HOME IN JUNE OF 05 ONLY TO LEARN THAT THE BUILDER HAD NOT GOTTEN THE FINAL INSPECTIONS ON THE HOME BASICALLY I HAVE BEEN PAYING 6 MONTH ON A HOME THAT I CANNOT LIVE IN BECAUSE IT IS NOT BUILD TO CODE THE ROOF DECKING IS NOT LONG ENOUGH AND THERE IS NO DRIP CAP AT ALL WHEN THE WIND BLOWS MORE SHINGLES FALL OFF REVEILING EVEN MORE GAPS AND HOLES. AFTER MONTHS OF CALLING THEM 3 TIMES A WEEK I STILL HAVE NO RESOLUTION. |

As I write, I am watching the 6 yr old rented house next door getting ready for sale. The painters are there, caulking all of the cement siding that is separating, caulking all of the cornice boards that are coming apart, caulking all of the window and chimney frame areas that are rotting, and caulking the wood areas around the garage doors that are separating and rotting. What a surprise the new owners will have in the years to come. |

We started the building process with Wilshire Homes. This was our first home and we were very excited about building. We started the process in May with a reasonable finish date of the middle of November. The middle of November came and the builder moved our closing date back to the second week in December. We were out of our lease for the house we were living in on Nov. 21 -- so at this point we're living in a hotel. The pushed back finish date wouldn't have been such a bad thing except that I'm active duty military and I'm deploying to Afghanistan Jan. 3. It's now Dec. 27 and we're still living in a hotel. We have a prospective closing appointment for Dec. 29 at 11:00, but at this point that's not a guaruntee. I would've liked to have had time to move my family into the house and get them settled before I left for my deployment. As a mother, it's important to me that my children are comfortable before I leave. Obviously, this isn't going to happen. If we actually get to close on the 29th, I'll only have a few days to move in before I have to leave. Our builder gave us unrealistic expectations and have put myself and my family in a bind. Staying in a hotel and eating out for a month isn't cheap. At this point I just want to close on my house and move on with my life. |

We purchased a new home from Mertiage Homes in Las Vegas, Nevada in their Yellostone Project. As an incentive to use their mortgage company, MTH Mortgage, they offed a $5,000 credit toward upgrades, or taken off the total loan at closing. When the house was ready to close, MTH Mortgage company was charging $3,100 for an ARM 5.8%. This same mortgage was free at Bank of America. IT is obvious MTH Mortgage was trying to recover their $5,000 incentive. When this $3,100 was disputed, MTH Mortgage dropped their lending rate to 5.6%, still charging $3,100. Bank of America was charging $800 for this same loan rate. On 12/22/2005, the house was scheduled to close. MTH Mortgage provided documents with the cash down payment of $69,391.68 on 12/21/2005. Cashier Checks were taken out of our bank in account in that amount. On 12/22/2005, during the closing, MTH Mortgage closing documents demanded $70,357.15 down payment to close. Other figures were also incorrect, and not the same as those given as the final figures the day before. MTH Mortgage alleged this was the error of Chicago Title Company, and wanted them to adjust their fees. Chicago Title Company refused, and MTH Mortgage had to agree to down payment they represented as being true and correct, $69,391.68. All documents were signed and notarized on 12/22/2005, and the funds accepted by Chicago Title. The contract was finalized. On 12/23/2005, MTH Mortgage called and stated they made a mistake and we owe another $5,100 for upgrades they did not account in the final contract and closing documents. The final closing documents were re-reviewed by myself, and they gave the impression these were the final, true and correct figures. MTH Mortgage and Chicago Title are now refusing to record the sale unless we pay an additional $5,1000 after the fact, and after the final contract has been consumated. It is our belief that MTH Mortgage, and MTH Homes have committed "bait and switch" tactics, and mortgage fraud in an effort to evade their incentive of $5,000, and to force a consumer such as myself to pay for their mistake. |

Hi, My name is Franklin Marcelino and i think you guys might be able to help me out on a story idea! I purchased a condo located in the "stonebridge commons" from pulty homes in the metrowest area in which i paid for 213,000.00 dollars and closed on it about one month ago! 5 days ago i got home and i had a major leak in my place, so i called the emergency line from the builder and asked them to investigate what was going on! The person above my condo has waste water all over her place and that is the water the is coming down the walls to my place! we both called the builder and it has been 5 days and they have done absolutely nothing about it, ignoring my phone calls and etc... basically i am living in a place full of sewer water all over the carpet and etc... a major health issue and they don't seem worried about it! I am going to persue the matter through a lawyer on monday since i couldn't solve it in any other way! the person above me who rents the condo above is also looking into solving this matter in some other way cause she has also not been successful otherwise! If this can make you guys a story on the news i would deeply appreciate it! Read Page 27 of the Homes section of the Houston Chronicle, Sunday 18 December, BBB ON HOMES, "Asks you to get the required building permits."
There are NO county building permits in Texas and TX does not license building Contractors of any kind, therefore there are also no inspections outside of city limits.
When will the facts as they are, ever be accurately given to the prospective home purchaser or renovator?
What a travesty of justice, or should I say, just another travesty.
I was somewhat surprised that the BBB would give out this misleading information.
The home building and renovation business is a real Buyer Beware situation in Texas, and other states that do not at least license home builders and renovation contractors. |

If the codes officials were doing a better job of inspecting and enforceing the codes most of these problems would not exsist!! So whos fault is it really? What I just wrote is true just look at the pictures on this website! http://www.badstucco.com If they were I wouldn't have any pictures!!! |

Good afternoon, In searching for an office that could assist me with my dilemna, your office came up. If this is not the office that deals with these types of problems please inform me who to contact.
In July 2004 I purchased a Pulte home in Wynnbrook, Schertz, TX. The home was a new home, and it was a spec home.
A couple of months in the home for the 3 month walk through, I informed the Pulte representative that I had two major problems to report.
1. One of the rooms, the den, was extremely hot all of the time. There was no air circulating in the room. Pulte sent out an A/C technician who informed me to close any vents in unused rooms and buy cheap vent filters. The problem continues. I have reported various times afterward, no actions taken.
2. Whatever is causing the problems with the air, seems to be affecting the carpeting. he carpeting is turning a greyish black around all of the corners, baseboards and in all of the master bedroom. I have also reported this. The first time they said it could be candles, Then they sent out Aladdin Carpet Cleaning to see if they could remove the spots. Aladdin stated it might be due to an air circulation problem or a crack in the foundation. Nothing else has been done. Meanwhile the carpets get worse. Everytime on of the PUlte Reps states that we need to get a carpet expert to come out, I had a different rep show up. This week they sent a carpet expert who informed me as well as Pulte that the carpet is ruined and the problem has to do with the air circulation. Meanwhile I am in a new home with ruined carpets and a room that does not have any air coming in to it. And have yet to speak to a manager - although I have made numerous requests.

My wife and I hired a contractor to build an addition on our house. He took over 23,000 dollars, never got any permits or code inspections before he started building, I have a signed contract, a code inspection report, checks from the bank. Most of his work had to be redone to pass code. We had to hire another contractor to finish the job before winter because he never came back to finish the job, or give any of are money back. This guy is a theif and has done this before. We found this out to late. Is there any way you can help us with this nightmare that just won't go away? Thank you,

Hurricane Wilma came about 2 months ago and my association still has not fixed my roof. I am about to loss all of my property because of their slowness. My association gets paid a lot of money every month and they don't take care of the property like there are being paid to so. I feel that L & B Property Managment is stealing from all of the homeowners. I need your help in getting this resolve.

In May 2005, We bought a unit in this newly constructed condominium built by John Ingravallo in Brooklyn, NY and it has been nothing but problems. 1st problem was air conditioning condensate drain pipe that was in my kitchen cabinet was not properly routed and drained gallons and gallons of water into my cabinets eventually overflowing and spilling out onto my hardwood floors. Needless to say, the floors warped and was a constant aggravation with the builder, Ingravallo, to get the floors replaced. 2nd problem, couple months later water began dripping down from my ceiling through one of the lighting fixtures in the living room. After 2 days the water eventually stopped dripping, and Ingravallo has never acknowledged that problem yet and has not even attempted to fix it. 3rd problem, its now Dec 2005 and my furnace stopped working. I have gone 2 weeks now with no heat. The person Ingravallo sent to fix the furnace showed up one day took it apart and then disappearred and never put it back together. Its now in the 20-30s degrees outside, so you can imagine how cold it is in the house as well. There are numerous other little problems with this condo. My advice with be to stay away from any house/condo built by John Ingravallo. This guy seems like the nicest person until he gets your money and then you're on your own. |
