Immediately after moving in, the Beckas say they began to have serious problems with their $318,000 home. Pipes burst behind walls and in the foundation, causing persistent flooding; an uncapped gas line leaked gas into the house; toilet water poured from the ceiling into the kitchen. The water damage spawned fast-growing toxic black mold. For more than five years, the Beckas put up with these problems and what they say were Huntington’s band-aid fixes...In January 2004, the Beckas approached the Council for help with a few commonsense ordinances...city officials did nothing...The Beckas warned their elected officials that if they did not cooperate, they would take the issue to the voters by collecting enough signatures to put amendments to the City Charter on the ballot...Take Back Your Rights presented the City Secretary with the fruits of six months of labor on the streets of Frisco—9,600 signatures, enough to force the City to put the amendments to a vote.

...the underlying theme of the Beckas' message is that life in the gated enclaves of Frisco is not what it's cracked up to be. Frisco City Hall is too boot-lickingly subservient to the home-building industry, they say. It has created an atmosphere where dream homes become nightmares and home buyers are without recourse... The Beckas are proposing changes to the Frisco city charter to provide home buyers with more ammunition in shootouts with builders...Twice the number of people who voted in the last general election in Frisco have signed petitions saying that home builders have too much power, too much sway, too much advantage at Frisco City Hall.

What's this? Do I see Take Back Your Rights in the Texas Residential Construction Commission's Texas Star Builder program? Would you trust your brain surgery to a surgeon who did not have malpractice insurance? I think not. However, the largest purchase of a lifetime is unsecured in Texas. The loss of your home due to shoddy construction can and does ruin lives, just as the slip of a surgeon's knife can do. The difference is that in the latter case, you have access to the court system.

Attorneys for city and TBYR volley legalities
"The Beckas hereby make a formal legal demand that at the next city council meeting, on or before Feb. 8, 2005, that you officially place the two Take Back Your Rights charter amendments on the May 2005 election ballot," wrote Fred Lewis, an Austin-based attorney representing the group headed by Frisco orthodontist Dr. David Becka. "The law is clear that you are required to put the amendments on the May 2005 ballot and failure to do so is a violation of your non-discretionary duties," Lewis wrote. Lewis is the leader of government watchdog groups called "Campaign for the People and "Clean Up Texas Politics." He said he is offering his services to TBYR pro bono, free of charge.

Passions grew as frustrations rose among the participants in the meeting - the Take Back Your Rights group, the City Council and residents in attendance. The meeting was an attempt to iron out issues regarding TBYR's efforts to create legislation designed to protect homebuyers from faulty construction of new homes in Frisco.
