The 10-year-old lawsuit of a Mansfield couple suing Houston-based Perry Homes was settled Wednesday evening, a court-appointed mediator said Thursday.
The two sides appeared in state District Judge Tom Lowe's courtroom Wednesday for a brief status conference but were instead immediately ushered into mediation. It was the third attempt at mediation in the case.
Terms of the settlement were not disclosed.
Bob and Jane Cull filed their lawsuit in 2000 against Perry Homes and a home warranty company over faulty construction. In 2002, an arbitrator awarded the couple $800,255, but Perry Homes appealed, and the case was sent back to the trial court by the Texas Supreme Court.
In March 2010, a jury awarded the couple $58 million following a trial. But Lowe never approved the judgment and sent the two sides to mediation to avoid further appeals. Mediation was again tried in December without success.
