Residents of Bluff View Greens:
After exercising a great deal of
restraint and careful thought I feel it is important that the community be made
aware of the newly elected Bluff View Greens HOAâs Boardâs backdoor approach
policy that undermines our original HOA Declaration
of Covenants, Conditions, and Restrictions (CC&Rs).
Although state law specifically prohibits any
changes to HOA CC&Râs without a vote by the HOA members, the powerful HOA
Management industry and related business interests simply devised a new and
dangerous law making policy by âresolution,â and to do so without consent or
vote by homeowners. Thereby giving the
board and management companies new found arbitrary power to impose new rules
and restrictions that undermine individual property ownerâs property rights and
ability to micromanage a community as they like.
Unfortunately the new Bluff View Greens
HOA Board recently did just that.
Without any notice to HOA members the board recently wrote and passed a âResolution,â specifically filing it as a Dedicatory Instrument with the country as they disregarded the
homeowners' rights to be informed, and vote on what they were
doing.
Since most residents living in HOA
communities are busy with life and generally do not have the time to attend
board meetings many are unaware of board members and managements bad decisions that
adversely regulate their lives until their community is featured in the news.
From a personal
point of view and as one of your neighbors who bought a home here when the
community first opened 18 years ago. For
the fist time I have never been so concerned about how the AMS Management / First
Service Residential has been
advising this new Board.
My concerns are based on my 30 years of experience
and service for a national non-profit consumer organization as well as a member
of Fair Arbitration Now, Washington D.C. I also served as a founding member of HOA
Reform Coalition of Texas where I had the privilege of testifying in numerous committee
hearings alongside a diverse coalition of professional consumer organizations, and
saw firsthand the controversial issues of overreaching business interest of
HOAâs.

previous board actions, HOA memberâs rights or the fact that HOA management
destroyed records.

Complaint:
After less than two months of
being elected in February the new Bluff Greens HOA board members choose to re-open old wounds by implementing disruptive tactics
that undermined the April spring community garage sale. âNewâ board members who openly oppose
community garage sales, behind the scenes claimed they had the ability to
disregard any previous board actions made last year in December to open gates
for Community Garage Sales.
A survey conducted by the board and a
door to door signature petition results, overwhelming confirmed that residentâs
approval to open gates for community garage sales. Believing that previous disruptive problems
by Association Management Services (AMS) / First Service Residential had been resolved the Spring
Community Garage Sales was scheduled for April in conjunction with other communities, however calls to AMS
management were not returned.
Important background of the eight month ordeal:
1. At the eleventh
hour (within 1 week) of the spring community garage sale without warning, the new
board made an uninformed decision. At
best the decision was made without the truthfulness or knowledge of previous
policy decisions as well as to the HOA managementâs (AMS) numerous failures to
notify all homeowners timely and/or to open the gates for Community Garage Sales.

In short: The purpose was to
explain the problems AMS management had created when they failed to return
calls and failure to notify Bluff View homeowners yet of the Spring Community
Garage Sale scheduled for the following weekend. See attached copy
3. April 04, 2015 â Shocking
email response written by Mr. Constantzos representing the Bluff View Greens
HOA to me.
His
email was shocking and certainly without merit or truthfulness and without
question left one to speculate as to the source for his fabricated assumptions,
especially since we had never met. His condescending
and lengthy lecture contained false,
misleading, and inflammatory statements.
In short: Specifically, Mr.
Constantzos made unwarranted assertions about my character referring to me as,
uncivilized, defaming, bullying, unprofessional, as well as an irresponsible
citizen of this community. His lecture
goes on to admonish me; âto refrain from continuously defaming any
of the members of this organization, to include members of the HOA managementâ
and to
making unfounded assertions and claims that I repeatedly âpersonally defamed, disgraced or slandered individuals,â among other inappropriate remarks. (To avoid any
further embarrassment to Mr. Constantzos I have not attached his email. However
his email is available for review in its entirety if there is any question as
to the truthfulness or accuracy of the quotes)
New HOA
Boardâs Disregard of Last yearâs (2014) results of a Board Survey: 78 members
responded to opening the gates for a Community Garage Sale â 40 Yes, 38
No. Additionally a door to door
petition was conducted: Sixty five Homeowners
signed the petition with 62 overwhelmingly in favor of opening gates for
community garage sales, with only 2 indicating âNoâ and one responded
âWhateverâ. Let me also point out that most people were not home and only
5 refused to sign.
4.
Very concerning
is a recent request to Association Management Services
(AMS) provided confirmation that the records were destroyed. AMS reply: âCopies of the completed feedback forms were not retained once the July
(2014) board meeting minutes were approved.â
5. Bluff View Greens
HOAâs Board explained they were elected as the winning political party and
passed a resolution giving power to the board to regulate community garage
sales. The Boardâs justification â
Written explanation from Bluff Greens HOA Board President â âI think that you would agree that, if a political party
is voted into an office, it does not need to follow the previous partyâs
decisions, regulations, policies, and laws. In fact, I would hope you agree
that the voters voted for the new party to have the rules changed.â⦠Paris Constantzos President of the Board of Directors Bluffview
