$1.5 million award in Pleasanton home mold trial [Bad Faith] (San Jose Mercury News, CA - May 5, 2005)

OAKLAND - An Alameda County jury has awarded a Pleasanton woman $1.5 million in punitive damages against her homeowner's insurance company, which she accused of mishandled a claim involving a leaky pipe and resulting mold.

Julie Radosevich, 49, won the punitive damage award -- which is intended to punish a wrongdoer and discourage similar conduct in the future -- against Amco Insurance Co. [Nationwide Insurance] last week at the conclusion of a five-week trial in Oakland. She was also awarded $53,000 in compensatory damages to cover damage to her home and emotional distress caused by the ordeal.

Mold to push another governor out of mansion (KTBS, LA - May 5, 2005)

BATON ROUGE (AP) -- Mold is forcing Louisiana Gov. Kathleen Blanco and her husband, Raymond, to make other living arrangements this summer.

The Blancos will vacate the Governor's Mansion after the legislative session so construction workers can clean the air ducts and replace the heating and air conditioning units.

VICTORVILLE - A judge has attributed water and mold damage in a mobile home to a Barstow woman's failure to repair water leaks in a timely manner.

Superior Court Commissioner Patrick Singer has ruled that Richelle Predmore, who bought the mobile home in Barstow from Tennessee residents Mitchell and Cassandra Scott, was responsible for the repairs.

Residents flee toxic mold as buyer, sellers bicker (Milwaukee Journal Sentinel, WI - May 9, 2005)

South Milwaukee - The hulking 37-unit Lake Ridge Apartments is a ghostly building that sits empty on the bluff over Lake Michigan because of a mold problem that promises to play out in court.

Just before Christmas 2004, Rick Michalski, a pharmacist who bought the building at 3303-05 Marina Road for $2.1 million in October 2003, told all the tenants to get out because toxic mold permeated the structure. Although the last tenants didn't leave until March, Michalski said he hasn't collected any rent since November, had to return security deposits and pay property taxes on the building.

Devon Paxson, his wife, Roslyck, and their three young boys say they're refugees from their waterfront Bay Village Harbour home, which they claim was poorly built and now is riddled with mold. And they're pinning the blame on E. Llwyd Ecclestone III and his wife, Patricia, who sold the home to the Paxsons. Also named in the Palm Beach County Circuit Court lawsuit is the builder, Ecclestone Signature Homes Co.

The Paxsons claim the Ecclestones built and sold them a lousy house, one with defects in its walls, windows and doors that let water seep inside. They discovered the defects after last year's hurricanes, when the home became "inundated with water," Paxson lawyer Robert Geisler said. An investigation revealed mold growing in interior spaces - mold that had been there for years prior to the storms, Geisler said.

Hundreds of construction workers from across the country have come to Kern County seeking hard work and good pay. They have found both, but a few have also ended up with a malady little known outside these parts -- valley fever.

The disease, caused by inhaling spores from a fungus native to the San Joaquin Valley and Arizona, has infected thousands of workers over the years.

Mold Education: Coccidioidomycosis (San Joaquin Valley Fever)

Coccidioidomycosis is the infection caused by the dimorphic fungus Coccidioides immitis. The disease is endemic only in regions of the Western Hemisphere. In the United States, the endemic areas include southern Arizona, central California, Southern New Mexico, and west Texas. The endemic region extends southward into Central and South America. An arid climate, alkaline soils, hot summers, few freezings, and yearly rainfalls ranging between 5 to 20 inches characterize this area.

Outbreaks occur following dust storms, earthquakes, and earth excavation where dispersion for arthroconidia is favored. Coccidioidomycosis is acquired from inhalation of the spores (arthroconidia). Once in the lungs, the arthroconidia transform into spherical cells called "spherules". An acute respiratory infection occurs 7 to 21 days after exposure and typically resolves rapidly. However, the infection may alternatively result in a chronic pulmonary condition or disseminate to the meninges, bones, joints, and subcutaneous and cutaneous tissues. About 25% of the patients with disseminated disease have meningitis.

GREENSBORO -- The night of Dec. 21, 2001, was supposed to be a happy time for Josh Sommer. It was the night before his 14th birthday, and Christmas was less than four days away. But Sommer felt terrible. That's because a largely unseen but aggressively lethal force was ousting him from the only home he had ever known. The strange and powerful enemy had already contaminated the air inside the house and everything in it, sickening Sommer and his mother, Simone Sommer, and even their dog and cat.

Almost three years after it opened, the Charleston County Judicial Center is a mess, judges, clerks and secretaries say. The $48 million building has had leaking, moisture and mold problems since it opened on a rainy afternoon in 2002.

"We evacuated the judges nine months ago," said Clerk of Court Julie Armstrong, who has helped manage the building crisis. "We've got them spread all over the complex, in all the nooks and crannies."

Mold & Legislation: Complete Text of Florida's Mold Assessment and Remediation Bill - Florida Statute 489.1134

489.1134 Mold remediation certification.-- (1)(a) In addition to the certification or registration required to engage in business as a contractor under this part, any contractor who wishes to engage in business as a contractor with a focus or emphasis on mold or mold remediation that is not incidental to the scope of his or her license shall take the courses or the number of course hours determined by the board. Such courses or course hours may count as part of the contractor's continuing education requirement and shall be given by an instructional facility or teaching entity that has been approved by the board. Upon successful completion of the course, courses, or course hours, the instructional facility or teaching entity that has been approved by the board shall report such completion to the department and issue to the taker of the course a certificate of completion, which shall be available for inspection by any entity or person seeking to have the contractor engage in business as a contractor with a focus or emphasis on mold or mold remediation that is not incidental to the license of the contractor.

(b) Any other natural person who is employed by a licensed contractor to provide work on mold or mold remediation shall, as a prerequisite to his or her authorization to provide such service, take a course approved by the board.

A Lee County woman wants a federal judge to decide whether residents with hurricane-damaged homes may join her lawsuit against Allstate Floridian Insurance.

Cape Coral resident Luann Guy, 50, has filed suit in U.S. District Court in Fort Myers contending Allstate didn't pay up when Hurricane Charley left her living with mold.

Stories of "the mummy's curse" or "King Tut's curse" excited the world after the discovery in 1922 of the ancient pharaoh's tomb in Egypt. Lord Carnarvon, a British sponsor of archaeology in Egypt, died shortly after attending the tomb's opening, inspiring speculation that supernatural forces were at work.

In recent years a scientific mummy's-curse theory was offered for Carnarvon's death. Was he killed by exposure to ancient, toxic pathogens from the sealed tomb? Did they prove too much for his immune system, which was weakened by a chronic illness he had experienced before he went to Egypt?
