Dec 27, 2001 Builders replaced by homeowners in Canyon Gate By:Norm Rowland, Staff  Action not necessarily related to specific problems but new director says a number of people are 'upset' with builders of homes in the subdivision. The Canyon Gate Homeowners Association elected three homeowners to the board of directors Dec. 17, replacing three builders' representatives and giving homeowners all five seats on the board.

The election results may or may not have been affected by problems two homeowners, Amy Weaver and DeLynn Archer, have been having with Royce Homes, according to Richard Kirkpatrick, one of the new board members.

Dec 19, 2001 Added new websites about Royce Homes in Katy TX. Please visit their sites about toilet overflows and sewage problems. Could that be why the surrounding homes are not selling?

Michael Thomas Homes, Royce, Enclave
Beware of what you CAN'T see when purchasing an "inventory" home from this builder!

My name is Amy Weaver, I am a single, working mother of two girls.  My greatest achievement or "dream home" for my daughters has turned into my worst nightmare!  A sewage flood, the day we moved in, was an omen to what was unknown to the naked eye.  It began the day we moved into our new home, which was March 4, 2000, when a toilet backed up and flooded the master bath/bedroom.  This was just the beginning of the many construction defects, which I would find, after hundreds of hours of research.

This home is approximately 3700 sq. ft., 2 story, all brick, costing approximately $248,000.  After 18 months of being in this home, the builder has yet to admit any defects with this home.  I have had numerous visits with various Employees of Royce Homes, repeating my story time and time again, with the same response, "we'll have to get back with you".  I have been told by their sub-contractors that there is absolutely nothing wrong with my home, yet have had various agencies confirm my allegations of poor workmanship.

Examples of the problems in this so called, estate home, are:

1)    sewer lines that do not meet state code, 3" versus 4" in a home with 4 commodes;
2)    sewer lines that have 5 bellies, therefore the sewage cannot drain properly to the sewer and  toilet's constantly backing up, requiring warnings to family and friends visiting to utilize the plungers in the bathrooms;
3)    gas lines that are not of adequate sizing to support the number of BTU's in the home;
4)    gas line behind stove was open for months, causing major gas leak in the home, where my  children and I experienced severe headaches for months before Entex located the problem;
5)    gas line to downstairs furnace was not even run, therefore additional gas line was run to the furnace, approximately 7 months after I moved in.
6)    rafters in the attic that are not to code, therefore not enough support to maintain the structure,  causing dips in the roof;
7)    wood floor on first floor is now discolored and buckled due to flood, causing mold contamination;

It is imperative that home buyers be aware of their rights, PRIOR to signing a contract with a homebuilder.  I am now in a situation where I am being forced into arbitration because of the arbitration clause in my contract.  I want to warn other trusting home buyers... be sure to know your rights by such organizations as HOBB.   It is time we stand up for our rights as consumers and demand justice from fraudulent home builders, do not let this injustice happen to you and yours.
