Houston, TexasFollowing a hearing of Tremont Tower Condominium Association vs Heather Jean Michelson, Harris Co. Civil Ct. No. 2, state and local officials are scheduled to join with HomeOwners for Better Building president Janet Ahmad and members at a press conference supporting homeowners FIRST AMENDMENT RIGHTS. 
 

            The president of Tremont Tower Condominium Association (HOA) and the developer/builder of Tremont Towers filed suit seeking to silence condo homeowner Heather Michelson by asking Judge Gary Michael Block to issue a permanent injunction banning Michelson’s artistic expression of lemons she painted on the windows of her defect condo.

            Michelson, a first time home buyer, alleges that Tremont was fraudulent when they breached the terms of their own contract by committing Loan Fraud, making material misrepresentations that the condo she purchased and the entire condominium building was free from defects.  Tremont, et al, further warranted the condo met all compliance requirements of city code related to the protection of the health, safety and welfare of its owners.

            Michelson petitioned Judge Block to deny the permanent injunction on the basis that Tremont Towers HOA, the builder/developer Tremont Towers, Jorge Casimiro’s “lack of clean hands” violated the common law of the “Clean Hands Doctrine.”

            In Michelson’s petition, she charges that the Plaintiff, “it’s associates, partners and agents acting in concert, have unclean hands resulting from participation in wrongful and illegal acts regarding the sale of the Tremont Tower condo” she purchased July 30, 2004.  Michelson further charged Tremont, et al “seek to deprive me of not only my freedom of speech, but also the full privacy and “quiet enjoyment” of my home” and further that Tremont Home and/or its agents were instrumental in contacting her employer, Hilti Corporation and the result of that communication led directly to the SUDDEN LOSS OF HER JOB.
