My family and I were being transfered to the great state of Texas. On several trips down to Texas we searched for homes, ending up in Little Elm.

We looked at a Highland home that was already finished and liked it very much. We returned to the sales office to ask questions regarding the house and the neighborhood. We specifically asked about the main road running through the neighborhood, El Dorado Parkway.

The sales representative told us that it was a neighborhood road that would give us another entrance into the neighborhood. We assumed that the representative was honest and truthful. That day we signed the contract on our new home.

We moved in July of 2003. In December of 2003 information came with our water bill that El Dorado Parkway would connect Highway I35 to the Dallas Tollway. And our neigborhood is between I35 and the tollway. This major corridor is called The Lewisville Lake Corridor Project.

This roadway is considered a highway. It is referred to as a significant thoroughfare and principal arterial. It is estimated to have between 35,000 and 45,000 cars a day in 2008 when the bridge over the Lewisville Lake is opened.

Highland Homes knew about the roadway and the purpose of it. They knew because John Baker, the developer of the subdivision, knew it. Mr. Baker built section 7 of the roadway,(the part of the road that runs through the neighborhood).

Highland Homes was deceptive and misrepresented the purpose of the roadway. They lied when we asked about El Dorado. We would have not purchased our home knowing that our children would be up against such traffic and noise and not able to access the amenity center safely.

The flow of traffic has already changed in our little town. Before the traffic went around the neighborhood and now a section of the old road has been removed, all traffic going through Little Elm comes through the middle of our neighborhood.

Leaving our amenity center of one side of El Dorado Parkway, and over 60% of the homes on the other side of El Dorado. Making it almost impossible to ride bikes or walk to the pool or playground.

Highland Homes has refused to meet with our committee of homeowners to discuss solutions to noise pollution, traffic and safety issues. Why won't they meet with us? Do you think their lawyers have something to do with that decision? Mr. Baker also refuses to meet with us along with the other builders, Landstar and Drees.

We went to the city of Little Elm for help. We asked the Town Council to call them and urge them to start a dicussion regarding solutions of our problems. Even after the Town Manager of Little Elm called they still refuse to meet with us.

Highland Homes has no regard for us, they deceived us and took our money. We are left with a house next to a highway that we can't sell. AND THEY DON'T CARE!

They took from us, our right to make informed safe decisions for our family. Do not buy a home from Highland, they are deceptive and dishonest!

transeasterm homes of florida/ tampa bay gulf is notorious for not caring for the people after they buy their homes. customer service is horrible. they also give sales gimmuk's to get you to buy and than dont follow thru with the promises. beware of their bad reputation.

Mcdavid homes in Mansfield TX.declined to repair flashing at the brickwork. It has leaked to where it
rotted the decking. The repair bill is $500.00. The estimator said it was because of poor design. Is there
anything I can do to recover the cost or complain. I have been in the home for 5 years. The builder would argue with you about fixing anything. Thank you for reading my complaint.

2-10 Home Buyers Warranty has included a condition of paying our claim that makes it impossible for us to accept. HBW's policy has many exclusions and does not really cover very much in the first place...for example they do not cover defects that are code violations and many construction defects ARE code violations. They also do not pay associated costs like legal or experts fees, alternate living costs, etc.

Now they want us to agree to drop pursuit of the builder, Fuller Homes, for costs not covered by the HBW policy in order to get their payment. This would cause serious financial damage and we could not fix the house with only HBW's offer.

HBW protects the builder, not the home owner.

It's unusual we even have an offer; we only got the offer at all because of protection from mandatory arbitration that exists/existed for FHA buyers. The regulation that got us out of arbitration is Title 24 of the Code of Federal Regulations 203.204g. The National Association of Home Builders has worked hard to get US Dept of Housing and Urban Development (HUD) to do away with this protection so it may not exist anymore.

I hope no other home buyer has to go thru the nightmare we have had with these companies.

My spouse and I purchased a home from Richard Fuller Homes, also known as Fuller Homes now, that has missing materials in both the framing and surface of the roof, major foundation failure, terrible grading, and other less serious defects. There are many cracks in the foundation, walls and brick, some of which are wide enough to stick my finger in. We have had a lot of expenses for structural engineers and other experts, all of whom agree the house has serious defects and will cost at least half its sale price to fix if it can even be fixed. While our house may be the most seriously defective in our development, about half the other Fuller customers here have talked to us about their problems too. At least one of them has foundation failure also.

Fuller was building in Oklahoma but still builds in Texas as well as New Mexico. Fuller was temporarily debarred by the US Dept of Housing and Urban Development but it was not enforced. Richard Fuller himself died in a plane crash, his own private plane, in 2003, but his family is still running the Fuller Homes company. Check the NM court records especially to see what's going on. We don't want to see anyone else be financially devastated by this builder or any other builder.

I am having a new home built a part of the electrical wiring has not been put in toN.E.C. code(#14 wire used with 20 amp breaker protection). Electrician is arguing that it is and I am positive it is not by other electrical sources, but no illinois electrical inspector or local code enforcement in logan county illinois

I am not in Texas, but BEWARE before you build. We are with a custom builder and they just did an extremely POOR job on the side walls of the foundation (major cracking, etc) which is sited in the wrong place on our lot. BE sure to get in your contract to have quality workmanship or that you can cancel the contract. With major repairs our stupid foundation walls will pass code! We are in the process of trying to see what we can do to get out of it, but this will cost us lots of money.

Drees Custom Homes lied to me! I asked what an incomplete four lane road that my lot backs up to...they told me not to worry about it. "This road will be an access road and will only have neighborhood traffic and school buses on it.", said Luis Tapia. I wasn't smart enough to take the con out of contractor. There were various other stories from the sales agent that were not at all true. Now, I have discovered that the four lane road is to become a highway and will be expanded to six lanes. The Town leaders have reported on several occassions that Drees knew the details. I live in Little Elm, Texas and the Town's leadership has done very little to protect people moving into this Town. They have done nothing for all of the residents that did not receive the proper disclosure.

After signing the purchase near 2 years ago, now we are running into outright greed from the builder. Initially, we viewed Classic Home builders in Woodbridge, VA as a honest, trustworthy company, because like many others, we relied on comments for one homeowner and the sale reps word. Because of delays in receiving our section's building permits, the builders were not able to provide us with a commencement date. Now that the permits have been released, the builders want to go back and INCREASE the base cost of the house to reflect what they could sell it for right now. We've been quoted as much as $80,000 more. It's outrageous. They want to profit from the equity we will have in the house. About a year ago, the builders sent us a letter stating they would not increase the price of the house. Now, they refuse to ratify the final contract or start building our house until my husband and I agree to the increase price. We've sought a lawyer to finding out if this practice is legal. The builder will not provide us with a written quote of the increase and specific reasons for the increase.

This is so frustrating becasue we've sold our home and place everything in storage waiting on our new home.

In speaking with the lawyer, it seems builders are using this tactic to push buyers out to receive a higher profit during the housing boom.

What can we do?

We purchased our home in 2003 from Home Towne building company. It was a pleasant experience first. We moved in and then noticed that we could not see out our windows. The quality of window that this builder puts in their home(s) are not suited for Michigan climate. There is a continuous cold draft during the winter by ALL of the windows, there is extreme condensation that creates pools of water, it is now creating black mold in my drywall and around my windows (non dangerous kind, I hope). The builder refuses to acknowledge the problem. This is not the only problem either with our home. Every neighbor that is in our phase has server problems with their windows as well. Other problems our neighbors are having is poor grading that the builder refuses to correct, electrical problems due to poor wiring, basement window problems that they will not fix. Management is careless and will not acknowledge the severity of these problems. I strongly caution anyone that is in the market to purchase a Home Towne Home. Finally, one of the owners of this company is EXTREAMLY arrogant and thinks that he is above any homeowner that purchases homes from his company.

Ryland homes in Central Florida leaked very badly during the recent hurricanes. Many homeowners saw subtle water signs in their homes before the hurricanes and have seen rain seep through their exposed block walls during normal rain since. Ryland is claiming none of this happened due to failure of a warrantable item, so they aren't going to fix the problems that occurred in 677+ (officially reported number) homes.

This issue is not a matter of build quality but rater an issue with delivery time. I have signed a contract with my builder that highlights two delivery dates. The first the original settlement data of January 25, 2005 and an extension to April 25, 2005. My contract was signed on April 25, 2004. I have made my own commitment based on the dates in the contract such as a mortgage commitment lock and rental housing.

I am six months into the process and have seen little progress on the site. As of November 11, 2004 I only have a foundation.

I have contacted my builder expressing my concern to meet the delivery dates indicted in the contract. Their response was that we not sure if we can even deliver the house by June of 05.

Please note this is not a custom home. This is a spec home that is in a development of about 60 homes.

Has anyone had a similar experience / results?

I own a KB Home I have several problems: Foundation cracks outside the home
Inside cracks on the sheet rock in three rooms,
Plumbing problems leaks in bathroom.

My home is 5-6 years old.

SMART BUILT HOMES SPRING BRANCH, TEXAS

My husband and I built a 1,600 square foot, energy efficient, steel
frame home which we paid $120,000 for. Since we moved in at the end of
June 2004, it has been a constant battle with the owners of Smart Built Homes - Spring Branch, Texas to repair our warranty issues.

I have a huge trail of e-mails and other correspondence where we request repairs, they respond and say they will repair, but after almost 5 months, we still have a list of at least 6 items that have not been repaired, although they keep promising to make repairs. They tell us they have bent over backwards to please us, but that we're being difficult and they can do nothing to make us happy.

Not only did they build us a poor quality house, but now they get angry at us because we keep calling them and e-mailing them to get our home repaired.

One of the major issues is our plumbing. We have major plumbing code
violations because the builder didn't use any licensed plumbers when they built our home even though the law requires licensed plumbers to be used in the construction of every new home, whether you are in a city or in the country. We have had numerous water leaks and floods where water was 1/2" deep in one of the bedrooms, sewer gas smells, and also drains and toilets that clog up. We also have air conditioners that didn't drain properly, walls that are crooked that the builders state they can't fix, water damaged finished concrete floor that they refuse to repair because we signed a waiver saying that "imperfections in concrete were unavoidable". The waiver never stated that gross negligence by the builder in choosing their subcontractors who caused damage to our floors was allowable, and yet, they refuse to fix our floors. Our roof leaked the week after we moved into our house and water was running along the walls in all of the front rooms in our house. We have been living with methane gas odor in our home that the builder claimed was due to our "existing septic tank" and they refused to have the plumbing checked by licensed plumbers to bring us to code.

I have filed complaints with the Attorney General, the Texas Residential Construction Commission, the Better Business Bureau and the Texas State Board of Plumbing Examiners. I also have a story that will be aired on KSAT-12 in San Antonio, TX sometime soon; possibly during the week of 11/14/04. Although I am getting responses, it is an extremely slow process trying to get our problems resolved and fixed.
