Running a law firm, the usual end-of- school year activties and end-of-youth baseball season (I have a kindergartner and second grader), and a never-to-be-forgotten bout of bronchitis took up all of my time.

Mold Exposure Joins Leading Personal Injury Claims with $925,000 Award (Business Wire, CA - Jun 2, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~  SOUTHFIELD, Mich.--(BUSINESS WIRE)--June 2, 2005--Mold exposure has jumped to the forefront of significant personal injury claims with a recent $925,000 award in Wayne County Circuit Court to an apartment resident. The verdict, the highest ever in Michigan for personal injury damages resulting from mold exposure, could ultimately force a new standard of liability on property owners and landlords.
The apartment resident, Esmeralda Mahaffy, developed permanent, severe asthma from exposure to high levels of toxic mold after her apartment was negligently repaired following a flood from a toilet in the apartment above her unit in 2001. The incident occurred after years of ignored complaints of water leakage and persistent mold on the walls and ceilings. The verdict followed a seven-day jury trial in April before Wayne County Circuit Court Judge John H. Gillis Jr.

Board of Health denies school board appeal; litigation may be next (Harvard Hillside, MA - Jun 1, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~  HARVARD -- In April, the Board of Health ordered the School Committee to remove carpeting suspected of being moldy in the Harvard Elementary School (HES) kindergarten wing by July 11 or face fines and/or closure of the wing.
The school board responded by appealing the order. That appeal was denied by the health board at a hearing Tuesday night, and it appears doubtful the matter has been settled.

How to Protect Workers from Mold (SafetyNext - Jun 6, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~  If you are concerned about your employees being exposed to mold through maintenance and remediation work, there are now some training guidelines for you to follow to protect them. In the absence of federal regulations and with the population of mold-exposed workers growing, the National Institute of Environmental Health Sciences (NIEHS) developed a set of training guidelines.
Guidelines for the Protection and Training of Workers Engaged in Maintenance and Remediation Work Associated with Mold is the outgrowth of two NIEHS- sponsored workshops aimed at developing experienced-based guidelines for protecting and training mold hazard assessors, mold remediation workers, and workers exposed to mold in the course of building maintenance. NIEHS notes that the guidance will need to be revised and approved as the understanding of mold issues grows.

Princeton Landing residents were sued by association to force them to move during repairs. (Princeton Packet, NJ - Jun 3, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~  PLAINSBORO - Seven Princeton Landing residents are claiming victory over the homeowners' association that sued to force them to move out while construction teams remediated mold contamination. On May 11, New Jersey Superior Court Judge Travis L. Francis denied the Forrestal Village Community Services Association an injunction that would have required the seven residents to vacate their Sayre Drive townhouses during construction.
Meanwhile, the association's attorney, Richard Kennedy, has filed a motion asking the judge to reconsider his conclusion. "The judge ruled the association did everything correctly," Mr. Kennedy said. "His conclusion doesn't seem to be consistent with what his entire decision is."

Appeals court says school negligence lawsuit properly dismissed (Duluth News Tribune, MN - Jun 1, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~  WAUSAU, Wis. - A judge properly threw out a lawsuit accusing a northeast Wisconsin school district of negligence when it built a new school that developed a mold problem years later, a state appeals court ruled Wednesday.
The lawsuit, filed by 20 parents and students and their health insurance companies, failed to show Wausaukee School District officials ignored a known and present danger, the 3rd District Court of Appeals ruled.

Mold Education: Antifungal Drugs - Polyenes
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~  These very potent agents act by binding to the fungal cell membrane and causing the fungus to leak electrolytes. These include the families Amphotericin B; Amphotericin B Lipid Complex (ABLC); Amphotericin B Colloidal Dispersion (ABCD); Liposomal Amphotericin B (L-AMB); and Liposomal Nystatin.
Amphotericin B binds to sterols, preferentially to the primary fungal cell membrane sterol, ergosterol. This binding disrupts osmotic integrity of the fungal membrane, resulting in leakage of intracellular potassium, magnesium, sugars, and metabolites and then cellular death. The mechanism of action is the same for all the preparations and is due to the intrinsic antifungal activity of amphotericin B.

School Mold: Open Meeting Law complaint filed with DA (Harvard Hillside, MA - Jun 3, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~  HARVARD -- Harvard resident Deborah Skauen- Hinchliff has filed a complaint against the School Committee, claiming it has violated the Open Meeting Law.
Skauen-Hinchliff maintains the board held an illegal meeting and executive session after a May 24 Board of Health hearing.

Mold & Insurance: FEMA Drops Bill on Belle View Owners - Repayment letters sent to over 100 owners. (Mount Vernon Gazette, VA - Jun 2, 2005)

Unlike mail received two years ago, however, these letters did not contain checks. Instead the letters are asking for repayment of some of the money given to owners paid out during the flood. Total sum asked for equals $195,799.15.

Pitt's Graduate School of Public Health (GSPH) and Pitt's European Union Center (EUC), located within the University Center for International Studies, are gathering academicians and policy makers from European Union member states Denmark, Finland, the Netherlands, and Poland as well as Canada and the United States to discuss methods for improving indoor environmental quality. The GSPH and EUC are cosponsors of a June 9 and 10 transatlantic policy conference, titled "Developing Policies to Improve Indoor Environmental Quality: Transatlantic Viewpoints," to be held at Pitt's Oakland campus.
The conference, which will consist of three sessions beginning at 8:30 a.m. each day, will address the difficulties in developing regulatory policies regarding indoor environmental qualities on both sides of the Atlantic Ocean, as well as the steps necessary in developing policies to protect public health in the context of indoor environments. The sessions will explore current scientific knowledge of indoor environments and related health effects; public health interventions and economic considerations; and policy needs, impediments, and recommendations.

~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~  Although Maine is not particularly known as a wet state, we have had a series of storms during the last week that have dumped an enormous amount of rain, about 6-10 inches total.
It seems that because of the constant moisture and lack of sunlight, we have a newly discovered epidemic to contend with. In an article by dermatologist William Gallagher, M.D. (Bangor Daily News, 27 May 2005, op-ed page), several patients with "wooly growth coming out of the ears, and similar wooly changes . . . found on the eyebrows" have been diagnosed with "Human Mildew," which is said to be a disease that gives the patient a "werewolf like appearance."
