Good Morning,

First of all, take a look at the fourth article for a pretty damning attack on Damp Indoor Spaces and Health by Senator John Conyers. That article notes, "However, the Institute of Medicine study has recently come under fire for issuing a press release that failed to convey that the study was only charged to investigate allergic and non-infectious respiratory symptoms of fungal exposure, and that their findings never included examination of other serious symptoms."

What I'm working on for upcoming issues of Monday Morning Mold:

  • More about the $550,000 Orange County, California mold settlement - information provided by Court B. Purdy (Wentworth, Paoli & Purdy), the Plaintiff's attorney
  • More about Erotium, with thanks to Dr. Nicholas Money, author of the fascinating and funny Dr. Bloomfield's Orchard and Carpet Monsters and Killer Spores
  • More about Kathy Davis, featured extensively in 2004 issues of Monday Morning Mold
  • Information about Trichothecenes, thanks to Attorney Steve Henning (Wood, Smith, Henning & Berman)
This week's photo is of Aspergillus flavus from the www.aflatoxin.info website.

SAD 28 sets Monday [Jan 31, 2005] mold meeting; RES East remains closed (Knox Village Soup, ME - Jan 28, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
CAMDEN, MAINE (Jan 28, 2005): School Administrative District 28 officials will hold a meeting for parents on Monday evening regarding mold and air quality issues that have kept students and staff out of the Rockport Elementary School East campus all week.
A water pipe burst between the walls in two kindergarten classrooms Jan. 22, flooding that part of the school. As cleanup efforts began Monday and first- and second-graders returned to school, workers discovered pockets of mold not associated with the flooding inside the wall cavities, prompting closure of the entire school.
Ten Tips To Avoid Mold Problems and Lawsuits in Selling and Buying Real Estate (WebWire, GA - Jan 28, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
LONDON, ENGLAND. Mold Inspector Laboratory International, Ltd. recommends that real estate sellers, buyers, and real estate agents/brokers, in the UK, USA, Canada, and worldwide, follow ten steps to avoid mold problems and lawsuits in the selling and buying of real estate properties.

1. A property owner should not even offer the property for sale, or list it for sale with a Realtor® or other real estate agent/broker, until after a thorough mold inspection and mold testing of the home, rental property, or commercial property. Hire a Certified Mold Inspector (USA and Canada), or use a do-it- yourself mold inspection checklist and mold test kits.

Facts May Calm Mold Madness (CBS News - Jan 27, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
(WebMD) People suffering from toxic mold syndrome - often blamed on a kind of black mold that grows on damp indoor surfaces - likely have more ordinary illnesses, a new study shows. The finding comes from a hard look at 135 patients referred to a clinic with expertise in mold exposure. Industrial hygienist and study researcher Michael S. Crandall, CIH, referred nearly all of the patients. Eighty percent of the patients had already hired a lawyer to pursue mold-related claims
The patients suffered from a variety of possible mold- related health effects, including respiratory symptoms, such as wheezing cough, and nasal discharge, or general complaints, such as skin rashes or joint pain. Yet after rigorous examination - including gathering detailed histories of exposure, home and workplace analysis, blood and skin tests for mold sensitivity, and two years of medical follow- up - there was no link between mold exposure, symptoms, and mold sensitivity.
Surgeon General's Office Issues Conflicting Message on "Toxic Mold" (PR Web, WA - Jan 27, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
In a move that spells trouble for tens of thousands of sick Americans, the Surgeon General of the United States is ducking the issue on questions concerning Toxic Mold. Despite direct objections by senior Congressional staff at a recent national health policy summit, the presenting researchers at the event made statements that mold presents no human health risks. However, Watchdog groups say that not only are study results that are driving national policy tainted by corporate influence, but that the follow up press statement on the event proceedings from the Surgeon General is deliberately misleading.

(PRWEB) January 27, 2005 -- On January 12th and 13th, the office of Richard H. Carmona, Surgeon General of the United States, conducted a two day clinic for public health professionals, titled "Surgeon General's Workshop on Healthy Indoor Environment". The event, which was conducted at the National Institutes of Health in Bethesda, MD, included panelists from public health agencies such as the Centers for Disease Control (CDC) and the Environmental Protection Agency (EPA), with various university and medical researchers participating as well.

Air traffic controllers at Detroit airport say mold clean-up made them ill (Detroit Free Press, MI - Jan 24, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
DETROIT (AP) -- Air traffic controllers at Detroit Metropolitan Airport are planning to file a grievance with the Federal Aviation Administration over a mold problem that forced the evacuation of a control tower over the weekend, the president of the controllers' union said Monday.
Around a dozen air traffic controllers were evacuated from a tower for five hours Saturday after they were sickened by fumes from a chemical being used to remove mold, according to Vince Sugent, president of the Detroit branch of the National Air Traffic Controllers Association.
Tenant concerns spur mold tests (Terre Haute Tribune Star, IN - Jan 30, 2005)
The black mold is in the corners, the closets and on their shoes, and some tenants at Garden Quarter Apartments are worried what it could mean for their health.
They said the residential complex has not been tested for toxins, but that is expected to change today.
Court Mold: To Breathe Or Not To Breathe (Tampa Tribune, FL - Jan 22, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
TAMPA - Florida's indoor air quality problems are widespread, authorities say in response to questions about ``sick building syndrome'' since a Tampa woman died recently with symptoms of Legionnaires' disease.

Suspicion of "sick'' government buildings is nothing new. Six federal courthouses in Florida, including two in Tampa, were diagnosed with the problem as recently as 2001.

Mold & Medicine: Deadly fungus infects 3 Australian tsunami survivors (ABC Online, Australia - Jan 27, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
TONY EASTLEY: Three Australians who survived the Asian tsunami are now again fighting for their lives after being struck down with a deadly fungal infection. An Australian man who was injured when the tsunami struck Sri Lanka is in the Infectious Diseases Unit at the St George Hospital in Sydney after developing mucormicosis.
The invasive fungal infection often goes undetected. It's very expensive to treat and kills up to 80 per cent of infected patients. The 56-year-old tsunami survivor is being treated by Dr Pam Konecny, who's the staff specialist at the Infectious Diseases Unit at the hospital.
Mold Litigation: Montgomery wins state Supreme Court [New Jersey] ruling in stucco case - Determination that a construction code offical can issue a notice of violation to a builder after a certificate of occupancy has been issued has statewide impact. (Princeton Packet, NJ - Jan 25, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
MONTGOMERY - A three-year legal battle ended yesterday when the township resoundingly won a state Supreme Court case that Mayor Louise Wilson said was taken on "to uphold the responsibilities of local government." The 5-0 decision, written by Justice Jaynee LaVecchia, concerned the authority of a construction code official to issue a notice of violation to the builder of a home once a certificate of occupancy has been issued. Chief Justice Deborah Poritz and Justice Barry Albin did not participate.

The ruling, said Justice LaVecchia, "promotes the salutary public policy goal of compliance with the Code." Township Attorney Kristina Hadinger said she was "delighted" with the ruling. "We couldn't have asked for a better outcome. It is not only a win for Montgomery and a win for municipalities statewide but, more importantly, for residential homebuyers in the state of New Jersey," said Ms. Hadinger.

This is a very funny website -- but a bit racy in places. For example, one of this week's feature stories is on the trauma suffered by American children as a result of last year's Superbowl Halftime. Here's one of the funny (but clean) news briefs from this week:

GEICO Saves 15 Percent Or More By Discontinuing Advertising WASHINGTON, DC-Executives at the car-insurance company GEICO learned Monday that they could slice 15 percent or more from their operating budget by discontinuing their extensive TV advertising campaign. "We couldn't believe it when we found out how much we could save by axing that ad campaign," said Tony Nicely, GEICO's chairman, president, and CEO. "Dropping that CGI gecko saved us a quarter of a million dollars-and it only took one phone call to our marketing department." Nicely added that sometimes a company has to save money to save money.
