Mark Eberwine: F. B. I. to Investigate Builder Fraud

F. B. I. to Investigate Builder Fraud
by Mark Eberwine

We recently learned that the Federal Bureau of Investigation has been asked by the Justice Dept. to investigate Fraud by Homebuilders.

The San Antonio U.S. Attorney’s Office has asked the FBI to Investigate Homebuilders.

This is a much needed investigation. For too long and too often Homebuilders have been allowed to build homes that leak and develop mold problems. Far too many foundations have failed to properly support the house superstructure.

Far too many times Homebuilders have piddled and patched the walls and ceilings of homes instead of buying the house back when the foundation has failed.

Far too many times the Homebuilder employs dilatory tactics until it is too late for the homeowner to file suit. Yes, the builders know that if they perform patchwork repairs for a couple of years and then quit returning calls, when the homeowner does finally sue, the suit can be dismissed because the homeowner waited too long (statute of limitations) to file suit.

Far too many times, the Homebuilder files paperwork with our Federal Government that ‘certifies’ that the house is being built in an area suitable for residential construction. In other words, the Homebuilder specifically states that the house is not being built on expansive clay soils, waterways, landfills, etc.

All Builders make mistakes. In 25 years I’ve never seen a perfect home or a home without multiple defects. However, what separates the honest Builders from the dishonest Builders is how they take care of the defects and treat their home buying client once the defects are brought to their attention.

There are many honest, hardworking, talented Builders in Texas.

For too long we have allowed dishonest and incompetent Homebuilders to operate in Texas. For too long, the Feds have allowed them to continue to operate and steal from home buyers and the taxpayer
