Owners stuck with flawed homes
Families' costs mount, but state, builder give scant help, files show

Buyer beware. Have an inspection done by a qualified company. And hope that all the work was done properly. Or hire a "white Hat" to oversee the entire project. There is no way I would drop $350K on a house without these basic things being done. Your builder is not your friend. He's a vendor like all the rest. Why would you drop $350K and not spend an extra 10K for second opinion. And listen to the posts on this article...blame the republicans? What kind of crap is that? Blame the builder, blame the city inspector, blame yourself for buying garbage. You were taken in by a fraud...I'm very sorry, I hope the builder gets what he has coming to him.

==============================Most people blame Republicans cause they are the ones leading the tort reform charge against "greedy lawyers". Everyone hates frivolous lawsiuits till they need to sue for damages, then the lawsuit isn't so frivolous. Maybe people need to wake up and vote for people who believe in a civil court system that benefits the public and business. Not just business. Oh well, must be a commie liberal for believing such ideas.

In my early twenties after years of being hyped up on the virtues of letting the law takes it course, I went to small claims court. I've never been back!
In essence, I was told I was supposed to already know about the product I was buying on pretty much the same level as the manufacturer and should have known this, that, and the other or should have hired someone who did. That's reasonable to a degree but anyway you look at that the need for a court system is a waste of tax payer money on the consumer level, because it just becomes tail chasing. If I had hired someone and they made an unfavorable decision then I should have checked their reputation, It becomes insane in pursuing liabilty.
Texas, for sure, does not have a consumer friendly Tort System.
Before that I used to have a just pereption of the law now I truly understand what it means The Law is about who is in control!
On another note that is why so many poor people wind up in prison!

No where has special interest money been more powerful and evident as Texas where builders freely build substandard homes, confident they will not be held accountable. It has been nearly 6 long years since “Bob the Builder” Perry and his builder friends bought, built and now operate the Texas Residential Construction Commission (TRCC). The state agency offers no help for aggrieved homebuyers, instead its process forces homeowners into costly protracted legal disputes ending in abusive Binding Mandatory Arbitration (BMA) that most can not afford.

What is amazing is that despite the years of overwhelming condemnation and negative news reporting of the scandalous TRCC “Builder Protection Agency” the State Legislature once again acquiesced to homebuilders last year.

Paul Burka, Senior Executive Editor of Texas Monthly summed it up best; “In the end, however, it still added up to lipstick on a pig, and not just any pig, but the ugliest, dirtiest pig the Texas Legislature has brought into existence in all the years I have been covering it. There is only one remedy for the TRCC, and that is to send it into oblivion.”

There is far too much blame to go around. For those of you who are appalled at reading “Owners stuck with flawed homes” please understand that it is our obligation as victims to fight for our basic rights that the building industry has systematically taken from us. No one group or group of organizations can possibly stop this madness that will continue to devastate families unless more become actively involved.

To texaschickee, girl u sure do c it simple. If someone gets a judgement it is up to the plaintiff to recover the money. Supposedly 1 is supposed 2 b able 2 able inform the court that the defendant has disregarded a judgement, the plaintiff pays another fee by way of the clerk and the Marshall is supposed 2 liquidate the defendent's property. I had enough with 1 round.

To everybody else don't get wrapped up on those sitcom Justice TV shows most of that is staged. When the cameras r off most of those judges talk in tongues (that's crazy to u and me). But do your thing because I'll certainly do mine!

I don't think that the Hispanic Culture has anything to do with poor quality construction. The builders were hiring the cheapest sub-contractors and pushing them to slap the stuff together quickly, they got what they paid for...yet...the builders then charge top dollar for their property...and don't want to pay a professional to follow-up on the punch-out list.
