Frustrated home owners protest builder Fogal and Mickelson contend they both have suffered the frustration of trying to get the builder of their homes, Stature Construction Inc. and Turner Construction Inc., to repair defects they say are due to substandard construction, including water leaks, possible mold growth and cracks in the exterior. Further, they say their choices for compromise are now limited... Fogal questions the ethics of allowing a group of individuals who may practice âdefectiveâ construction building to participate in further home development. Moreover, she says there is a complicated web of business entities that share managing officers â a group that includes the builders and developers of her home and Michelsonâs â and that itâs extremely difficult to get straight answers from them. |

Disgruntled home owner turns to Better Business Bureau Houston River Oaks Examiner - Jordan Fogal Since she and her husband purchased a $360,000 town home in Montrose's Hyde Park Crescent community at 1515 Hyde Park Drive, Fogal has been battling with Stature Construction, Inc. to fix repairs she contends are due to substandard construction... Fogal has also turned her energies to consumer advocacy, and has been assisting other distraught homebuyers, consulting with anxious Realtors afraid of being sued for selling faulty buildings, and lobbying state legislators to change housing laws. On Monday, Fogal joined a group of unhappy home owners at the state capitol to lobby lawmakers to make builders more accountable by making proof of expertise and financial responsibility mandatory.

When Jordan and Bob Fogal purchased a $360,000 town home in Hyde Park Crescent in April 2002, they thought they were making a sound investment... "The first night we were there, my husband took a bath on the third floor and water leaked all the way down to the first floor," she said. As the months passed, she said, the home continued to deteriorate. The stucco on the outside walls began to crack, the kitchen leaked badly and the house began to smell... Tremont is forcing the fogal's into binding arbitration which Jordan describes in this article as: "You've got people blindly walking into arbitration, hoping to get a fair deal, but they're not going to. It's like a drunk driver suing you for denting his car with your head." |
