CAUSE NO. 00-09-05-961

District Court of Montgomery County Texas

FACTUAL BACKGROUND

"This suit is necessary as a result of the failure of the Exterior Insulation Finishing System (EIFS) on Plaintiff' homes.  Life Forms clad Plaintiff's homes with an exterior insulation finishing system (EIFS).  EIFS is more commonly known as synthetic stucco.  Plaintiffs purchased their homes based upon representations by Life Forms about the quality and durability of the EIFS cladding.  Plaintiff's homes have had water penetration which has led to excessively high moisture levels in the cladding and structural damage from rot and termite infestation.  The homes have been contaminated with molds, including toxic molds, and/or are at risk of developing same because of the excessively high moisture levels in the cladding.  Some of the Plaintiffs have suffered personal injuries due to exposure to toxic molds and other molds to which they are allergic.  At least two families have been forced to leave their home in order to protect the health of their children.  The water damage is so extensive in some of the homes that the homes cannot pass a pre-sale inspection and  cannot be resold."
