Good Morning,

Welcome to summer!

This morning's photo is of mushrooms and toadstools (which hopefully ARE NOT growing indoors!) from the www.academiaexchange.com website. My assumption is that it's a composite. Who ever said mold isn't beautiful?

Hot tips on mold? Please let me know. Send information to This e-mail address is being protected from spam bots, you need JavaScript enabled to view it , Cynthia Coulter Mulvihihll, Esq Hyde Mulvihill APC 216 W. Foothill Boulevard Monrovia CA 91016.

Las Vegas Building Boom Plagued by Construction Defects [audio story] (NPR - Jun 20, 2005)

Note from Cynthia Coulter Mulvihill, Ed., Monday Morning Mold: This story is quite interesting, but about mold only inferentially.

Morning Edition, June 20, 2005 · Nowhere is the nation's home buying and building binge more visible than in Las Vegas. On average, 200 new residents arrive every day needing a place to live. That has led to a rash of lawsuits over construction defects.

Mold in new condos prompts San Diego City Attorney Michael Aguirre to halt sale of bonds (San Diego Union Tribune, CA - Jun 25, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
Home-builder Corky McMillin Construction is scrambling to remove mold from 44 condominiums it built at the former Naval Training Center (Pt. Loma) during last winter's heavy rains.
The problem has prompted City Attorney Michael Aguirre to halt a bond sale of up to $16 million, some of which McMillin planned to spend on the first phase of a 46-acre regional park at the property, now called Liberty Station, west of Lindbergh Field. The City Council approved the bond issue May 24.
Realtors Join in Effort to Stop Mold (RisMedia.com, CT - Jun 23, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
RISMEDIA, June 23 - A new public education campaign by the National Center for Housing and the Environment (NCHE) and supported by the National Association of Realtors aims to help the public become more informed and smarter about mold. It's a common problem homeowners face.

This month, a new public service announcement will begin airing on television and radio stations across the country to educate consumers about moisture problems which can lead to mold growth in homes. Creepy mold creatures lurking under a leaky sink illustrate how moisture can lead to serious damage in the home. Viewers and listeners are urged to visit www.stopmold.org where they can learn more about the causes of moisture problems in the home and how to solve them.

Door County landlords cleared in lawsuit over mold infestation - Jury finds apartment residents negligent with own property (Green Bay Press Gazette, WI - Jun 24, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
STURGEON BAY - Two Door County landlords virtually walked away from a civil lawsuit Thursday that sought to pin blame on them for a 2001 mold infestation at their Baileys Harbor apartment complex.
Landlords Robert Doneff and Richard Langdon were not only exonerated - the 12-person jury also found that the apartment residents who filed the suit were negligent with respect to their own personal property.
Woman Blames Mold For Killing Husband, Father, Family Pet (WBAL Channel.com, MD - Jun 23, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
PIKESVILLE, Md. -- A woman moved into a Baltimore County condominium, thinking it would be her retirement home and a quiet place to live with her husband. But soon, her family started dying of cancer and she's suing the builder -- blaming the mold.

WBAL-TV 11 News reporter Darrielle Snipes reported Juanita Coleman said it's no coincidence that her family -- and even her pet -- contracted cancer. Her condominium council conducted tests showing mold was in several units due to defective construction.

Mold Education: Medical Mycology Procedure Manual (www.doctorfungus.com)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
The procedures describe one way to achieve the stated goals and are offered on an "as is" basis. Valid variations on these procedures (or indeed, entirely different approaches) are possible. If you choose to use these procedures as the basis for work in your laboratory, you should carefully review them for applicability to your setting. The kits and reagents we use may not be equally available in all parts of the world. In addition, the frequency of specific fungi in other parts of the world may require changes in the procedures. Includes the following:
  • Laboratory Regulations and Safety Rules
  • Coordination of Specimens, Results and Reporting
  • Laboratory Information System DownTime
  • Mycology Rotation Guidelines for Students
  • Examination of Specimens
  • Collection and Transport of Specimens
  • Isolator Blood Cultures
  • Culture Collection
  • Ocular Micrometer
  • Yeast Identification
  • Mould and Aerobic Actinomycetes Identification
  • In Vitro Antifungal Susceptibility Testing
Mold & Insurance: Undetected leak could cost couple $50K - State Farm Denies Coverage (North County Times, CA - Jun 23, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
OCEANSIDE ---- An Oceanside couple who bought their "dream house" on a hilltop near College Boulevard and Highway 76 in 1991 has found that life there is anything but dreamy after a leaky pipe caused tens of thousands of dollars of damage that their homeowners insurance company says is not covered by their policy.

Even with all the space in their 2,500-square-foot Marbella home, Donald and Lavella Halvorson don't have a lot of room to spread out. Their days are spent cooking, eating, sitting and talking in an 80- square-foot foyer walled off by stacked boxes filled with their personal belongings.

Mold & Legislation: Florida Governor Jeb Bush vetos Toxic Inspection Mold Bill (Free-Press-Release.com - Jun 24, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
Tampa Florida: NJMI New release June 23, 2005 Governor Jeb Bush of Florida. In a letter to the Florida Secretary of State the governor stated that the state was not prepared to limit the current practices for the mold inspectors practicing mold investigations. The Mycological Institute for Fungal Mold in Human Habitations supports the Governor's position that the Florida legislature bill can be considered worse than nothing since it causes more problems than it solves.
In quoting the Institute's medical mycologist and aerobiologist Professor Josef Doumanov "Clearly standards must be set out in detail but rushing out licensing and regulations in what is clearly a professional practice without a complete training and standards program outling the same is unacceptable".
Mold & Legislation: Out with the 'Mold,' in with the New - New York Senator Carl Marcellino Announces New Task Force Created to Assess Toxic Mold (LongIslandPress.com, NY - Jun 22, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
Legal and environmental experts have called toxic mold infestation the 21st century equivalent of asbestos in its potential for both litigation and health problems. But Sen. Carl Marcellino (R-Syosset) announced the "Toxic Mold Task Force" on June 22, saying it's time for New York State to evaluate the issue of toxic mold and the danger it presents to people within buildings and structures.

"This is a positive step in evaluating health risks and reviewing government regulations or standards concerning containment or remediation of identified toxic mold in our homes, schools and commercial buildings," says Marcellino, chairman of the New York State Senate Environmental Conservation Committee.

Mold & Legislation: Contractors must abide new state laws on mold removal (Sherman Denison Herald Democrat, TX - Jun 19, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
WESLACO - New state laws require contractors to have training, insurance and certification to assess and remove mold. "Things have changed," said Dr. Mani Skaria, a mycologist and plant pathologist at the Texas A&M- Kingsville Citrus Center in Weslaco. "Two years ago, there was no control. Contractors who didn't understand the biology of mold were actually making the problems worse, causing a lot of damage and increasing the health risks to the public. But the new rules have weeded them out."
Skaria worked with Texas Department of State Health Services and the Texas A&M University System to disseminate proper mold remediation techniques until the Texas Legislature acted.
