Good Morning,

Okay, for all my fans -- thanks for the e-mails, and I am getting caught up. Check out the "For Fun" section -- it's a hysterical poke at attorneys -- and a good reminder to me to make liberal use of plain English and a good editing pencil.

This week's photo is a Vascular Plant Microphoto 2004-021, scanned microphotograph, image size = 34 x 21 cm, aspect ratio = 1:1.618 from the the Doug Craft Fine Art website (www.dougcraftfineart.com). It doesn't have anything to do with mold, but it's beautiful.

Hot tips on mold? Please let me know. Send information to This e-mail address is being protected from spam bots, you need JavaScript enabled to view it , Cynthia Coulter Mulvihihll, Esq Hyde Mulvihill APC 216 W. Foothill Boulevard Monrovia CA 91016.

Mold Follow-Up: Inspector: Mold and rot worst she's seen - Jury will hear closing arguments Monday (Peoria Journal Star, IL - Apr 24, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
lacon - The mold-infested rural Varna home that has been the focus of a civil trial in Marshall County Circuit Court last week made a memorable impression on the industrial hygiene expert who inspected it slightly more than five years ago.
"I've been in a lot of bad mold-contaminated areas. This was the worst situation for wood rot that I had ever seen," Susan Naschert testified Friday in a trial over allegations that the home's previous owner and a Realtor concealed its condition from a couple who bought it in July 1999.
Clothes Washer Mold Follow-Up: Maytag Settles Neptune Washer Lawsuit (Consumer Affairs - Apr 19, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
Maytag has settled a consumer class action suit alleging odor, mold and mildew problems with Maytag Neptune Washers.

More than two million consumers are included in the class, and may receive repair reimbursements, replacement costs up to $500, and/or washing machine purchase certificates up to $1000

Moldy conditions at apartment subject of new class action (Madison County Record, IL - Apr 19, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
Kesha Manning of Venice filed the first class action lawsuit in Madison County in more than a month against the owner of her apartment complex because of mold and fungus problems. The Bissel Apartments, located at 1400 Klein Ave., house at least 25 individuals, the complaint states.
Claude Taylor, a plumber who worked at the apartment complex for more than a year, also is listed as a plaintiff and class representative. Manning and Taylor are represented by Lanny Darr of Alton and Scott Morgan of Chicago.
HEALTHY OUTLOOK Advice on dealing with problems with mold (Contra Costa Times, CA - Apr 21, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
I OFTEN GET calls from Contra Costa residents wanting the county to send someone to check their homes, workplace or school for mold problems. Many are worried that mold is making them or their children sick.

Determining if mold in your home is causing a health problem is tricky business. There aren't any legal or medical standards to determine if the type and amount of mold in a particular building is a health hazard.

Ontario, Canada's Provincial Home Warranty Program Not Working (Canadian TV News, Canada - Apr 23, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
When Donna Rushton moved in 2002 to a brand new house in Angus, Ontario, a small town an hour's drive from Toronto, she thought it would the last house she ever bought. "This was to be our retirement home," she says.
But right away there were problems. No stairs on the second-storey back porch, so she had to walk around from the front of her house to get to the backyard. That was just the beginning.
Mold Education: Antifungal Drugs - Glucan Synthesis Inhibitors
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
The glucan synthesis inhibitors are, collectively, agents which are presumed to block fungal cell wall synthesis by inhibiting the enzyme 1,3-beta glucan synthase. As technical issues in the laboratory have made formal proof of the assertion that this enzyme is actual target of these compounds, it is most correct to speak of them at present as being glucan synthesis inhibitors rather than glucan synthase inhibitors. There are three such agents at present, with all three belonging to the chemical family also known as the echinocandins.

Trade & Generic Names & General Features Formerly L-743,872 and MK-0991, caspofungin is a polypeptide antifungal related to pneumocandin B0. It is a glucan synthesis inhibitor of the echinocandin structural class. It is manufactured by Merck Research Laboratories and its trade name is Cancidas (TM).

School Mold: Parents Worried Mold Taking Over Athens School (WAFF, AL - Apr 21, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
A moldy mess? Parents want to know if there child's school has dangerous spores growing in the classrooms.
"There's a lot of unexplained rashes, frequent nose bleeds,' described Brookhill parent Leah Stephens.
Court Mold Follow-Up: Mold cleanup delay takes toll on federal court (Palm Beach Post, FL - Apr 21, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
U.S. District Judge Daniel T.K. Hurley was about to impose a federal prison sentence on a woman convicted of drug trafficking when he got an urgent message on the bench: Her family had flown in from the Bahamas to speak on her behalf, but there was a problem.

They were waiting at the federal courthouse in West Palm Beach. No one told them that the courthouse at 701 Clematis St. had been closed and the sentencing had been moved to Fort Lauderdale.

Mold & Insurance: Public Hurricane Model to be Unveiled; Insurers Question its Reliability (Insurance Journal - Apr 25, 2005)
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
A controversial $2.7 million state-financed public hurricane insurance model will be unveiled and posted on the Internet in May by Shahid Hamid, director of financial research at Florida International University's International Hurricane Research Center.
According to Hamid, the model will give consumers and state regulators an opportunity to see how various assumptions about hurricane risk and possible losses can be factored into setting insurance rates. They say information provided by the model will provide the state with ammunition against requests for larger rate increases.
For Fun: Overlawyered.com
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
This is a very funny site, dedicated to lawyering run amok. I know what you are thinking, but it doesn't include ever lawsuit ever filed -- see www.lexis.com or www.westlaw.com for that.) The site is a bit difficult to navigate, but worth the time. Here's a selection with editor's notes about those e-mails from law firms:

This communication is from a law firm and may be privileged and confidential (we are too busy to check each E-mail we send out so we're placing the onus on you to read this crap and figure out if it applies to you). If you are not the intended recipient, please notify the sender by reply E-mail (which may include spoof E-mail generated by computer viruses) and destroy all copies of this communication. Seriously, we mean ALL COPIES, so if you get an unintended E- mail you should march right into your IT department and insist that they delete the backup tapes and stand there to make sure they really do it. Lastly, you should know that the sender's name and other information in this E-mail are for informational purposes only and are not to be considered electronic signatures.
