Microb Phase Laboratories Scandal Follow-Up: Mold 'whistle blower' removed (Fairfield Minuteman, CT - March 11, 2005)

EASTON - Town selectmen removed Beverlee Dacey from her position as an alternate member of the Board of Finance Thursday because, they say, her term should have expired in 2003. But Dacey, who said that she was the only person removed from a town board due to a term error, claims the move was made in retaliation for her actions as a whistle blower.

As a member of Easton School Building Committee 2003, which was charged with improving air quality at Samuel Staples Elementary School, Dacey and two other committee members sparked a local and federal investigation into Microb Phase Laboratories for alleged environmental crimes. The New York company sprayed an unkown substance to eliminate mold in Staples and Helen Keller Middle schools, as well as many other schools in the country.

Luann Guy didn't think she was in good hands with Allstate after Hurricane Charley wrecked her home, leaving water and mold in its wake.

The single mother of two still lives in her Cape Coral home infested with mold. And after weeks turned to months without payment from Allstate Floridian Insurance Co., she filed what her lawyers hope will become a class action case against the company.

A Sandy family who claimed that toxic mold in their newly built house made them sick has won a half- million-dollar judgment against Beaverton-based Adair Homes Inc.

The decision is one of the first jury verdicts on mold in the Northwest, a spokeswoman for the Oregon Trial Lawyers Association said Monday. Nationwide, the issue has alarmed homeowners and has led to hundreds of lawsuits and billions of dollars in insurance payments, even though a government panel reported last year that mold in the walls of homes did not appear to pose a serious health threat to most people.

(PRWEB) February 24, 2005 -- Los Angeles Superior Court Judge Warren Ettinger, has ruled that Dr. Juan Manuel Gutierrez, Ph.D., Board Certified neuropsychologist may offer his expert opinion that exposure to toxic mold was the cause of a Plaintiff's permanent brain injury.

In the case of Dee v PCS, Plaintiff Darcee Dee, a former resident of Mammoth Park Towers in Sherman Oaks, California -- billed as "Luxury Apartment Homes, Completely Renovated" -- has filed for damages in a suit in Los Angeles Superior Court. The defendants PCS Property Management LLP and 8611 Venice Blvd. Corp are either owned directly or indirectly by another LLP whose principle is local PCS Telecommunication"s magnate, Joe Fryzer. The defendants own and manage 40 other high end luxury apartment buildings in Beverly Hills and Los Angeles, promoted with the motto: "We don"t just say it, we mean it. Better Living Better Life".

BARSTOW - Richelle Predmore and her teenage daughter were anguished and perplexed, unable to deal with an ongoing illness they couldn't pinpoint. After moving into a mobile home, they suffered from frequent sore throats and headaches. But whenever they left their recently purchased trailer, the two immediately felt better.

"We didn't know what was happening,' said Predmore, 46, a cancer survivor living on disability income. "Both Sarah and I would become ill again when we returned to the mobile home.'

GREASEWOOD SPRINGS - Mold growth in the middle of the desert may seem unlikely, but that's exactly what Amy Begay and more than 25 other homeowners in Greasewood have to deal with.

"I'm really worried about my grandson (and his health); he's 5" Begay said as she pointed to the dark spots growing in the corner of her closet, cracks around the windowsills, and a puddle of water on the floor

Mold Education: InformeDesign Takes on Indoor Air Quality - A study conducted by the University of Minnesota examines indoor air pollutants (Interior Design, NY - March 11, 2005)

The review studies the adverse health effects airborne contaminants have on people residing in residences with polluted indoor air. Those conditions can include respiratory diseases, allergies and other immune deficiencies, lung cancer, skin and mucous membrane effects, sensory and central nervous system responses, cardiovascular diseases, and organ systemic effects, especially concerning the reproductive organs and liver. The biggest airborne culprits inducing these effects include tobacco smoke, mites, mold, radon, volatile organic compounds, formaldehyde, and carbon dioxide.

Design decisions, according to the report, can significantly impact the health of a residence, and thus designers must be aware of how they can affect the level of indoor air pollutants in a home. According to the newsletter, areas that deserve particular attention include fireplaces, kitchen ranges, furnaces and boilers, and attached garages, all of which, if poorly vented, can allow carbon dioxide, carbon monoxide, nitrogen dioxide, and other harmful pollutants into the air. Below-grade spaces and other areas susceptible to water intrusion could allow mold to grow or radon to leak into the air. Built- out spaces, carpet, building products, finishes, and furnishings can all off-gas VOC's, formaldehyde, and HCHO's into the air, contaminating it.

School Mold: Study renews concern about Kilauea fumes (Honolulu Star-Bulletin, HI - March 12, 2005)

Public concerns about fumes from Kilauea volcano have revived since the release of the first half of a study that assessed the possible health effects of long-term exposure to low levels of sulfur dioxide gases.

The study by Oregon State University warned that residents living downwind from Kilauea might have elevated risks of respiratory and cardiac problems because of high levels of sulfur dioxide and aerosol particulates.

FORT PIERCE - A spike in St. Lucie County absentee rates and children's over-the-counter prescription sales during a six-week stretch might show more about a tough flu season than the post-hurricane health of schools.

For its second time, the St. Lucie County Health Department delivered to the School Board on Tuesday data from three existing studies originally designed to track outbreaks of illness and bio- terrorism events.

The Fergus Falls family suing a local painter and a real estate company claiming they bought a house filled with toxic mold from them filed their first depositions in the case last Thursday.

The Daily Journal reported in October that Rick and Kristyn Swendsrud claimed they and their two daughters were suffering severe health effects from living in a house on the 600 block of West Channing, which they bought in April 2003.

With the filing deadline of April 11, Prieto is hard at work both gearing up for his election campaign and attempting to put together more legislative bills to bring to the Assembly floor.

Additionally, Prieto stated that he had another idea for a bill and currently had his legislative staff working on penning the language for it. That bill, known as Assembly No. 3895, provides for registration of mold inspectors and remediators and adds the same layer of protection for consumers by ensuring quality work by the contractor.
