HOA Reform Coalition Supports CSSB 142
Priority of Payments Provision would apply payments in this order: 1) any delinquent assessments; 2) any current assessment; 3) any attorney fees or third party collection costs. Homeowners have been trying to get meaningful legislation for more than a decade. The present laws have allowed HOA abuse and tens of thousands of foreclosures across the state - devastating to both  homeowners and to property values.



CSSB 142, as presented by Senator Royce West, with amendments by Representative Burt Solomons, has provided what can be the first meaningful legislation to provide some help to Texas homeowners living in mandatory homeowners’ associations.
 
Most important to homeowners is the Priority of Payments Provision would apply payments in this order: 1) any delinquent assessments; 2) any current assessment; 3) any attorney fees or third party collection costs.

Homeowners have been trying to get meaningful legislation for more than a decade. The present laws have allowed HOA abuse and tens of thousands of foreclosures across the state - devastating to both  homeowners and to property values.

The Texas HOA Reform Coalition is comprised of concerned homeowners and homeowner organizations including the Home Owners for Better Building, Texas Homeowners for HOA Reform, Inc., and Texas Housing Justice League.  The coalition was formed in 2010 with the intent of bringing a unified voice to the Texas Capitol.
