Testimony by Janet Ahmad before the Texas Sunset to AbolishTRCC |

TRCC is contrary to responsible public policy
Currently there is no incentive for builders to construct homes with care to get it right the first time. TRCC is an ill-conceived policy that places the burden squarely on homeowners, rather than the builder. Forgotten is the inspiring slogan âMade with Pride in American?â... History will record the legacy of TRCC as shameless domination by the builderâs agenda to limit responsibility. An agenda designed to punish consumers through industry domination of smoke and mirror policies â bolstered by the State.
TRCC is contrary to responsible public policy
Sunset Hearing on TRCC by Janet Ahmad
Sept. 23, 2008
Thank you Mr. Chairman and Committee Members: My name is Janet Ahmad, national president of Home Owners for
Better
Building
.
Something is wrong when, you canât tell the difference between Fannie Mae, Freddie Mac and TRCC â where government begins and the private sector ends.
Something is wrong when, Sunset Staff concludes that TRCC has failed, and there is no justification to continue with the agency or even attempt to fix it. That âTexans are better served without the TRCCâ¦â
Hurricanes are unavoidable but TRCC is a man made tragedy. Please, its time to bail-out homeowners â Abolish TRCC.
Currently there is no incentive for builders to construct homes with care to get it right the first time. TRCC is an ill-conceived policy that places the burden squarely on homeowners, rather than the builder.
Forgotten is the inspiring slogan âMade with Pride in American?â
By establishing TRCC as a burdensome process daunted with bureaucratic roadblocks for homeowners; fearless and confident bad builders carelessly throw up houses and simply ignore homeowners. To that end TRCC aided in pushing 88% of aggrieved homeowners into costly binding arbitration, or to simply give up in submission; setting an historic hallmark of bad state policy.
Policies that serve only to deceive the public with a false sense of security, which blindsides families left with Worthless State Mandated Statutory â Limited Warranties.
History will record the legacy of TRCC as shameless domination by the builderâs agenda to limit responsibility. An agenda designed to punish consumers through industry domination of smoke and mirror policies â bolstered by the State.
In light of the extraordinary opportunity given to the building industry that created this lopsided agency, at this stage why should anyone trust the imaginary world of the building industry that claims to be âThe Expertâ on what is good for consumers? The last 5 years of TRCC has proven that what is good for builders canât be good for homebuyers.
Homeowners helplessly standby frustrated as their homes and values fall, all because of industry greed and higher profits without accountability.
We must restore pride in the building industry so good builders will be eligible to proudly display, âMade with Pride in
Texas
.â
Next time we must get it right and truly protect the largest purchase a family will make rather than the largest mistake. The public must be assured protection from unscrupulous and unqualified homebuilders when buying a new home.
A home is a families most costly and basic need. Anything short of repeal of TRCCA would be a tragic injustice to families of
Texas
.
