HomeOwners for Better Building, the San Antonio-based group that has been in the news for fighting builders and its president's tactics, is celebrating because the state's Sunset Advisory Commission recommended that the Texas legislature abolish the Texas Residential Construction Commission.

The Express-News published this Houston Chronicle story about the recommendation.

In its report released this week, the Sunset Advisory Commission stated "the Texas Residential Construction Commission fails to provide meaningful oversight and public protections because of fundamental flaws in the current regulatory approach" and so its one key recommendation is "abolish the (TRCC) and repeal the Texas Residential Construction Commission Act."

The Sunset staff who wrote the report said that despite changes last legislative session the TRCC "still has no real power to require builders to make needed repairs" and "good intentions are not a substitute for having adequate statutory tools."

HOBB National President Janet Ahmad praised the recommendation in a press release. "The report is a consumer victory and goes a long way in restoring confidence in our state elected officials to do the right thing for genuine consumer protection this next session, Ahmad said in the release.

Every two years the Sunset Commission reviews some of the state's regulatory entities and makes recommendations as preamble to the opening of the biennial legislative session. It's up in the air as to whether the elected officials will follow the advice.

Consumers can make their feelings known during a public hearing Sept. 23-24 or online.
