Ripoff Report: Legend Homes, TRCC-State Builder Protection, Warranty! What Warranty?

Legend Homes New Home falling down in 5 yrs due to poor workmanship and foundation Houston Texas
Our home has shifted almost 4', the brick is cracked, water is coming in all the windows, our attic has shifted, walls are cracked, windows are cracked, shingles are coming off our roof, roof is buckled, electrical has been pulled loose from the wall with loss of electric and shifting, toilet drainage is going up instead of down and numerous other issues. Our house is suppose to have a warranty of which is no value. Warranty company does not want to work with us or fix the problems. The state of Texas TRCC has given us a favorable ruling with the builder Legend Homes.  Legend Homes says they are not at fault and it is strictly a warranty issues and they are not responsible.

We purchased a 2 year old home from an individual in August 2004. We lived in the home for 2 years and placed our home on the market to sell. We moved to another home and during the process of selling our Legend Home, a severe foundation/structural problem was discovered in 2006.

Our home has shifted almost 4', the brick is cracked, water is coming in all the windows, our attic has shifted, walls are cracked, windows are cracked, shingles are coming off our roof, roof is buckled, electrical has been pulled loose from the wall with loss of electric and shifting, toilet drainage is going up instead of down and numerous other issues.

Our house is suppose to have a warranty of which is no value. Warranty company does not want to work with us or fix the problems. The state of Texas TRCC has given us a favorable ruling with the builder Legend Homes.

Legend Homes says they are not at fault and it is strictly a warranty issues and they are not responsible.

A house that was 5 years old should not be falling down. We have an attorney and filed against Legend Homes for their poor workmanship and structural foundation of the home and now we are 2 years later and the house worsens everyday.

Legend Homes has acknowledged we have a problem, the warranty company has acknowledged we have a problem, the TRCC for Texas has acknowledged we have a problem, a structrual engineer has acknowleged we have a problem, BUT as our house is falling down, no one is trying to help us fix it and they all claim it is not their responsiblity or problem.

Why should a homeowner
expect a new home of 5 years to completely shift 4 inches and the whole house become unstable be responsible for fixing and the be responsible cost of all repairs due to the poor quality of the house.

We have tried mediation without results. Legend Homes has gone before the court, a trial was set 6 months ago, has asked for an extension and was granted another 6 months. We are already into this for 2 years.

Every time it rains, water pours into the house from the windows. The roof is unstable. In 6 months there may not be a house in quesion. We have been responsible for these 2 yrs for all payment on a house
that is almost non-livable and now it will continue because Legend Homes will not accept responsiblity for the poor quality on this home.

We have checked with the TRCC and there are numerous other complaints on this company. Wish we had known who the builder was when we bought and knew to look up their building reputation. New homes should be in excellent condition and last longer than 5 years.

We have found numerous other individuals in our neighborhood with the same problem. I found one on the next street over from me with the same house plan and the same problems. Since she was the original owner she was forced into arbitration and given a sum of money and forced to sign a confidentiality agreement and can not discuss Legend Homes.

The others I have found, are in the same situation as us and trying to get help to fix their homes. They also have found nothing but road blocks trying to get help.

Consumers need to look at builders of home and their reputation and it should not be this difficult to try to get a house fixed under a warranty and only 5 years old.

Please consider your homebuilder before purchasing and if it is a Legend Home, you might want to have a structural engineer
or excellent inspector look at the home with a magnify glass.

Personally we will never buy another home from this builder and in our opinion would not advise anyone to purchase a home
from this company.
