McGraw finds, sues home improvement business
Changing its name didn't stop one Kanawha County business from being sued by West Virginia Attorney General Darrell McGraw. McGraw filed suit Tuesday against Superior Windows, Inc., and WDS Marketing after receiving several complaints that the home improvement companies did not perform the work for which they were paid. "Consumers who pay for home improvements expect to receive the goods and services they purchased," McGraw said. "Superior Windows and WDS Marketing did not properly install or repair the products, leaving consumers with water leaking into their homes or defective windows."

CHARLESTON, W. Va. - Changing its name didn't stop one Kanawha County business from being sued by West Virginia Attorney General Darrell McGraw.
McGraw filed suit Tuesday against Superior Windows, Inc., and WDS Marketing after receiving several complaints that the home improvement companies did not perform the work for which they were paid.
"Consumers who pay for home improvements expect to receive the goods and services they purchased," McGraw said. "Superior Windows and WDS Marketing did not properly install or repair the products, leaving consumers with water leaking into their homes or defective windows."
The company was called Superior Windows until January, when it changed its name to WDS Marketing. Along with the name change, Craig Carver no longer listed himself as the company's president. Instead, his wife Teresa took over.
WDS Marketing sells and installs replacement windows, patio rooms and related goods and services. Superior Windows is listed on Insurance Commissioner Jane Cline's website as being in default on its Workers' Compensation payments.
WDS Marketing, meanwhile, does not have a contractor's license and has not filed to file a certificate of assumed name with the Kanawha County Clerk, McGraw says. McGraw adds that WDS is not honoring express and implied warranties and do not provide a complete contract to consumers.
The suit is filed in Kanawha Circuit Court.
