Texas Residential Construction Commission
 has no power to enforce its findings

Houston, Texas —   The Houston Chronicle published an article Jan. 6, 2005 titled, “A whole lot of talk yields little action” by Purva Patel which reports the Texas Residential Construction Commission (TRCC) “has no power to enforce its findings.” http://www.chron.com/cs/CDA/ssistory.mpl/business/2979768

 

The report featured homeowner, Mindy Brooks of Ft Worth as one of the first to go through the TRCC, State-Sponsored Inspection and Dispute Resolution Process (SIRP).   According to the article the commission’s inspector confirmed defects in the home, however the builder has refused to make repairs.

 

HomeOwners for Better Building has been critical of the TRCC process and points to the nine member homebuilding industry commission, as the fundamental flaw. 

 

“The Brook’s  case and many who have tried to file a complaint against their builder confirms what critics have said all along – TRCC was never intended to regulate the homebuilding industry but was written to regulate homebuyers left with defective homes – those who can least afford it,” said Janet Ahmad, National President of HomeOwners for Better Building. 

 

“It’s astonishing.  What other state agency charges the consumer a fee to file a complaint?Consumers need a state agency that truly regulates and licenses builders and gives them an incentive to build a home right the first time; something TRCC fails to do,” concluded Ahmad.
