Non Holder of Note - Mortgage Company Forces Foreclose on Home

RE: MORTGAGE FRAUD DIVISION                       
       Pursuant to your jurisdictional responsibilities 

Dear FBI:

I am writing to you about a massive nationwide mortgage servicing fraud ring operating out of Dallas .  The company EMC MORTGAGE CORPORATION in Irving , Texas is currently under federal investigation by the Federal Trade Commission after I was requested to meet with the FTC attorneys in July 2005 at their Washington , DC headquarters.  As you know, EMC is also under investigation by the Texas AG office and others across the country.

I have been embroiled in litigation over this fraud since I was targeted ten (10) years ago, when it was alleged that I was in default on my mortgage and as the Owner & Holder of my Note, they were entitled to foreclose.

In December 2004, my case finally went to trial in the 134th Judicial District Court with the Honorable Anne Ashby presiding:  CAUSE NO. 02-8531-G / ROBERT JOHN WRIGHT v. EMC MORTGAGE CORPORATION

At the opening of the trail, EMC stated to the court that they had made a mistake and they were NOT the Owner & Holder of my Note and therefore did not have legal standing.  This meant they had committed massive fraud upon the courts over these years by  knowingly making false statements in their pleadings, affidavits, depositions and court hearings.

On the fifth day of trial, EMC’s representative, while under oath, admitted I was never in default, actually overpaid my escrow and admitted they had done this intentionally to steal my home and equity.  Within moments, the judge shut down the trial and later recused herself.

My reason for writing to you is the court will not allow anyone (including law firms), access to the trial transcript.  One legal researcher was quoted $1,000.00 per page.  The customary fee is $1-$3.00 per page.  A Texas law firm was told the above admissions are not in there, indicating possible evidence tampering and obstruction of justice.  There is also an audiotape of the trial, but when one researcher requested it, she was told it is “not available”.  I filed for indigence and was denied (without any rebuttal), because my indigence status would allow me to obtain the transcript without cost.  EMC cannot allow that.

The inability to get this crucial evidence has caused EMC Mortgage and their counsel Fulbright & Jaworski to continue litigating against me by suing me -- and the courts have granted them my home based on nothing more than more fraud upon the courts.  This gross injustice, abuse of power, ethics violations, perjury and continued fraud has absolutely stunned and dumbfounded seasoned attorneys as to the injustice of the courts and their complete refusal to follow the law and protect public policy and civil rights.

I must plead with you to obtain the transcript from the court reporter listed below.  Without this evidence, EMC Mortgage will take illegal possession of my home through criminal activity on TUESDAY, DECEMBER 12, 2006 at 9:am when the constable shows up for the third time.

If that is allowed to happen, I will be homeless and penniless after losing all my resources by preventing the illegal attempts to protect my Homestead Exempt home.  I no longer have the resources and will suffer irreparable harm once this crime is consummated as it will be too late.  I will lose the contents of my home as I have no place to go or the funds to move.


Please contact the court reporter below for the transcript.  Ms. Udall is well aware of my case as many have called trying to get this critical evidence to bring EMC Mortgage and their counsel to justice.  Lawyers refer to this evidence as the Silver-Bullet to save myself and countless others victimized by this nationwide shell-game.
