HELENA — The 9th U.S. Circuit Court of Appeals reversed the decision of a federal judge who dismissed a lawsuit seeking repair or replacement of 203 houses on the Blackfeet Indian Reservation that residents claim made them sick.

In a ruling issued Friday, the court reversed the District Court's dismissal of the lawsuit against the Blackfeet Housing Authority but agreed with the dismissal of the lawsuit against the federal Department of Housing and Urban Development.

ORANGE – Six families were in court Friday as a judicial officer approved a settlement to their mold- contamination lawsuits against a now-closed Newport Beach day-care center.

The youngsters – whose parents say they suffered from ailments such as hearing loss, ear infections and vomiting after their stays at Childtime Childcare – will get an undisclosed amount of money. The actual amounts were sealed.

After EEOC dismisses complaint, Ex-detective sues Glouco prosecutor for mold problems (Cherry Hill Courier Post, NJ - Jul 20, 2006)

A former detective for the Gloucester County Prosecutor's Office alleges in a lawsuit he was forced into retirement after he repeatedly complained about working conditions in the office of the prosecutor's Narcotics Task Force. William Reichert, 43, of Woodbury, contends that exposure to toxic mold in the office affected his speech, making it difficult for him to do his job.

In February 2000, the task force moved into a separate office on Glover Street in Woodbury. Reichert contends he began complaining about the working conditions soon after, but his superiors ignored his concerns. By April 2004, "plaintiff's speech became strained at times and difficult to understand," according to the lawsuit filed Monday in Superior Court.

Toxic Mold Found In Folsom Condos (KCRA.com, CA - Jul 20, 2006)

FOLSOM, Calif. -- Dozens of homeowners said they've been cheated out of hundreds of thousands of dollars after being duped into buying condominiums filled with dangerous levels of toxic mold. Some residents are getting sick and officials said an investigation is now under way.

Staci Disilva said four months ago, she paid more than $240,000 for an apartment at Waterford Place in Folsom. But she's not living in the unit because it's filled with toxic mold.

Greater Binghamton distributing FEMA mold report - Mayor: Residents should take steps if mold, mildew shows up in flooded homes (Press & Sun-Bulletin, NY - Jul 21, 2006)

To help educate the community about the health risks of mold and effective remediation, the city is coordinating the distribution of a FEMA report to properties affected by the June floods. Personnel from the fire and police bureaus and the city codes department will be going today and tomorrow to homes inspected last week to deliver a manual from the Federal Emergency Management Agency, according to a Friday news release from the mayor’s office.

Mayor Matthew T. Ryan said he has heard from community residents and experts that some city properties are showing signs of mold and mildew. “Residents and property owners should not take this matter lightly,” he said. The mayor’s office urges those affected by the flood to review the manual carefully and perform the necessary remediation, which could be as simple as scrubbing contaminated areas with bleach and water.

Latino Immigrants Working Without PPE in Gulf Coast (Occupational Hazards, OH - Jul 21, 2006)

Many Hispanic day laborers have flocked to the Gulf Coast to pick up reconstruction and cleanup jobs in the aftermath of Hurricane Katrina, but a new report finds that many of these workers face a host of work- related hazards, with no personal protective equipment (PPE) available.

Exposure to mold, toxic materials and body fluids from decomposing corpses were just some of the perils Latino immigrant workers faced while working in the Gulf Coast area, according to the report "Risk Amid Recovery: Occupational health and Safety of Latino Immigrant Workers in the Aftermath of the Gulf Coast Hurricanes," which was published by the University of California Los Angeles Labor Occupational Safety and Health Program (LOSH) and the National Day Laborer Organizing Network in June.

Mold Education: FEMA Publication - Mold: A Health Hazard

MONTGOMERY, Ala. -- One of the worst effects of water damage comes in the form of mold. Following a hurricane or severe floods, mold may develop, causing serious health problems. The state and the U.S. Department of Homeland Security's Federal Emergency Management Agency (FEMA) are working to inform the public as to the health hazards associated with mold, what can be done to minimize mold, and what ways can be effective in cleaning up mold.

If your home has water damage, mold could develop in as short of a time as 24 - 48 hours of water exposure. Even worse, it may continue to grow until steps are taken to thoroughly dry out the premises and eliminate the source of moisture. The Centers for Disease Control and Prevention (CDC) says that you may recognize mold by the sight-wall and ceiling discoloration, and smell-a musty, earthy odor.

 


School Mold: Does $500,000 Mold Remediation Mean Building Can be Purchased without Voter Approval? (Pawtucket Times, RI - Jul 21, 2006)

PAWTUCKET -- A lawsuit settlement that would rap the knuckles of the School Committee for its lease- purchase of the former Registry building at 286 Main St. -- but could still leave in place what many see as a good deal -- could come up for a City Council vote as soon as Tuesday. That’s when a special council meeting has been tentatively set, at which the local lawmakers may also vote on whether to put the purchase of the building before voters in a November referendum.

Mayor James E. Doyle, echoed by several councilors, has opposed any purchase of the building without voter approval. That buying the former Registry makes financial and educational sense has been little disputed. The city’s own recent revaluation of the 62,000 square foot property put its value for taxes -- typically 20 percent or more below what it would sell for on the open market -- at $1 million more than what its owner had agreed to sell it to the schools.

I'm considering planting currants on my property. But I've been told that currants can cause some type of disease in certain pine trees. Is there any truth to this? Any insight is appreciated. - D.P. in Swan Lake

This is a very good question to raise since there always seems to be a lot of misinformation on the currant-to-pine "connection." Both currants and gooseberries (members of the genus Ribes) serve as alternate hosts for the fungus that causes white pine blister rust. Therefore, planting currants and gooseberries near white pines (or any five-needled pine) and in moist areas can potentially lead to losses of the trees. White pine blister rust causes significant damage in pine forests by forming cankers on the branches of white pines. These cankers ultimately kill the trees. Black currant is the most susceptible of the Ribes species.

Bronchitis is an inflammation of the air passages between the nose and the lungs, including the windpipe or trachea and the larger air tubes of the lung that bring air in from the trachea (bronchi). Bronchitis can either be of brief duration (acute) or have a long course (chronic). When people suffer repeated bouts of bronchitis, they may have a more serious health problem, such as asthma, chronic bronchitis or emphysema, that need attention.

When we breathe, small, bristly hairs near the openings of our nostrils filter out dust, pollen and other airborne particles. Bits that slip through become attached to the mucus membrane, which has tiny, hair-like structures called cilia on its surface. But sometimes germs get through the cilia and other defence systems in the respiratory tract and can cause illness.

In a tiny town in rural upstate New York, sci-fi fans are correcting what they see as one of the great blunders in television -- NBC's decision to cancel the original Star Trek series. On a sweltering Saturday afternoon in Port Henry, N.Y., James Cawley works on what looks like a Hollywood set. His life-sized replica of the USS Enterprise bridge sits in what used to be a used car dealership on the outskirts of town.
