Man charged in plot to kill federal judge, prosecutor
The indictment of Anthony "Tony" Erpenbeck Sr., 71, is just the latest twist in the legal troubles of the Erpenbeck clan and its failed building firm, Erpenbeck Co. The large Northern Kentucky home building company folded in 2002 in a $34 million fraud that victimized home buyers, subcontractors and almost three dozen banks.

Home-building law has more than a few cracks
...Jo Hayman...  She formed her company, Cheetum Custom Homes, to prove a point.  She won't build a single house. Instead, the physical therapist wants to show how easy it is to get into the home-building business in Texas.  All anyone has to do to build a home is pay a $125 fee and register with a new state agency, the Texas Residential Construction Commission, or TRCC. "It's absurd," says the Plano woman, now the Dallas-Fort Worth representative for HomeOwners for Better Building. "Almost anybody in this state can be a builder today, and there's no way to stop you unless you are a convicted felon."   ... And under regulations set by TRCC's nine commissioners, most of whom have ties to the home-building industry, items that aren't covered after the first year include roofs, siding, windows, bricks, tile, carpet, flooring, doors, trim, drywall, plaster and stucco.

 The ordeal, she claimed, had left her with debilitating symptoms known collectively as multiple chemical sensitivity syndrome, or MCS. Currently, the medical community classifies MCS as a "syndrome of unknown origin," like Gulf War syndrome or chronic fatigue syndrome. By now, Lively-Diebold is used to cynicism about her condition. It's one of the reasons she wanted to find "the type of architect who would listen to your input, not just tell you what you need to have."

January 28, 2005 -- Chicago – With an avalanche of consumer complaints piling up and at the request of the office of Attorney General Lisa Madigan, Cook County Judge Peter Flynn this afternoon entered a temporary restraining order (TRO) against a Cook County construction and home repair company and its president after they allegedly bilked 31 consumers out of approximately $2.1 million.

Builder awaits fraud sentence
Calkins case reminds many of Erpenbeck
A Fairfield home builder is awaiting sentencing for bank fraud in a case reminiscent of the Erpenbeck scandal that rocked the region. Federal prosecutors say Chester Calkins and his wife, Antonette, did not pay off construction loans on 47 condominiums purchased with cash… It is unclear what sent Chester Calkins, who was president of the Greater Cincinnati Home Builders Association in 2000, into financial collapse. The company is in bankruptcy, and Calkins has been convicted of writing bad checks in Ohio.

Also contained in the contract is a biased arbitration provision that specifies the use Construction Arbitration Services (CAS) . If that isn’t enough, the final clause in the agreement could cost homeowners their home – “A SUM EQUAL TO THE PURCHASE PRICE, OF THE HOME,” if the owner appeals the arbitrators’ decision to the appellate courts.
