Hello.
My name is Jeff. I hate to start on a new forum with a post like this, but we are looking for help.
First of all, we closed on our Lennar built home December 23rd, 2006. It is here in Houston, TX. The floor plan is a "Hartford". We had paid for custom painting, custom wiring and everything to make it cozy out of our pocket (non-Lennar affiliated). We have had some major problems with our house this far putting me out of work since JANUARY for 6 vacation/PTO days and 1 vacataion/PTO day for my fiance so they could come and repair. Problems are to include -
- Pedestal sink in powder room was never hooked up - water ran onto the floor after sinked filled up. Had to submit service call for them to come out. Sink had to be masterfully taken apart and fixed then put back together.
- Shower in master bathroom clogged up. Had to submit a service call for them to come out. Drain was "plugged" with a glue from the building process.
- Noticed a "water leak" on the downstairs living room floor that we thought dog had done. The next night, the "leak" was in the same spot and I felt a drop on my head (so it wasn't the dog). I heard running water in my living room ceiling. Come to find out, the kid's bathtub upstairs was draining from upstairs into the ceiling downstairs in the living room. Had to submit a service call for them to come out. Plumbers came in, tore out the ceiling in my living room and had to replace the PVC drain pipe to the tub upstairs. Water was flowing freely through the nearest points of exit which were the "live" electrical smoke alarm and the return air duct to the air conditioning. The ceiling was "patched" back but you can still see where it was patched. I still think the water ran all the way down the ceiling joist into the powder room but they said it didn't.
- On final walkthrough of house, I noticed some bubbling in the wall in my daughter's bedroom. It looked like water damage to me. The QA inspector said that he would just "skim" it and fix it. We had a HUGE rain for the first time late January. I noticed my daugther's room upstairs had some bubbling in the wall around where the fireplace goes to the downstairs. A few hours later the paint was falling off the wall and there were holes where water was pouring out of. I took my finger and punctured the wall and the water ran freely. I called in for a service call. The response time was horrible. I waited two days for them to call me with a time to come to my house and that way I could plan to take off work again. I waited for 6 hours that day for the warranty team to show up to my door. I had to complain to the construction manager for that team to even show up. They came in, inspected, and ripped out a 1/4 of the wall in my 4 year old daugter's room. This was a day long process. What they told me was that there was never ANY flashing up on the room for the chimney. None. I am worried now that we risk mold damage to my upper and lower stories of my house. Lennar sent out the "plumbers" against my wishes to inspect the plumbing. I told them there was NO PLUMBING on that side of the house at all. They said "we just want to be safe". They did eventually get it fixed and repainted.
- On final inspection of my house, Lennar and I noticed there was NOT a fresh air return for the chimney. That was a code violation so we could not close on our house. Lennar came out, ripped out the little bit of aluminum that was in the wall and placed a plastic cover over it so we could close on the house. Major violation on code there.
- Recently, I noticed that the fence has a huge 2.5" inch gap on where the post meets the gate. My latch is barely catching on to hold the gate closed.
- I was out the other morning going grocery shopping. I came back 3 hours later to a house that smelled STRONGLY of propane. I immediately went and checked the stove and it was clearly off - oven and stove. I smelled throughout the house and smelled the gas stronger from the air conditioning ducts. I went out to the garage to open the attic and a wave of gas hit me. I immediately went and turned the main breaker off to the house and opened windows and doors so the house wouldn't catch a spark and ignite. I called the gas company to come out. Upon arrival he said he smelled gas but not that strong. I told him it was a lot stronger before. He asked that I turn on the main breaker to the house. I went to do so and I hear an alarm and the gas worker ran down the attic and told me to cut it back off. He went back and inspected and found out BOTH the gas water heater AND the A/C-Furnace had leaks. BOTH of them. Two stationary pieces of equipment 7 feet apart from one another. We had never smelled gas before until that morning. The gas worker "red tagged" 5 locations up in the attic that he found to have leaks. He did check the gas dryer and gas stove and found them to be "safe" and no leaks. We called in a service call and they are supposed to come out Tuesday, June 6th (four days after service call was put in) between 9A - 12P. We have been without gas and the use of A/C since Saturday on the wishes of the gas worker.
These are all the problems we have experienced so far. Here it is the very first of June (5 full months) and we have had this many problems.
Do we have any rights at all to seek some sort of "Lemon Law" for houses? Was this just a case of "let's get it built quick so we can close"?
Suggestions anyone?
