I was just reading about the Censorship that City-Data and other Forums had done regarding complaints against various builders.

A similar event occurred on a TOPIX Forum, which I had posted 33 posts in, warning consumers to do their due diligence in checking out ANY Contractor, especially, one of my Hot Button Nemesis variety, that being the Out Of Towner Storm Chaser Con-tractors.

During the course of that thread, which started off as a discussion primarily about one Storm Chasing company in particular, it was noted that many posts were getting deleted.  Huh

Well, it now seems that I was just talking to myself in that thread, because every one of the other posts have been deleted and I read on an Illinois Attorney Blog Site, that 18 of the Anonymous Posters are now being sued for Libel/Slander by the company mentioned in that thread.

The point is, that you can, by innuendo, get your point across, without subjecting yourself to a lawsuit if you dance precariously enough while posting your comments.

Read my post below that I entered on several other Construction Forums.

Storm Chaser Contractor Files Suit Against 18 TOPIX Forum Posters

--------------------------------------------------------------------------------

WeatherGuard Construction just filed a lawsuit last week, against 18 anonymous "John Doe's" who posted in a TOPIX Forum regarding their company.

Here is a link to the 12 page complaint for: "Libel/Slander"
http://www.illinoisconstructionlawbl...oes%201-18.pdf

I too posted in that thread, which had over 330 replies, but as usual, I did not pre-judge or slander or libel the identified company, because I have no first hand knowledge about them, just hear-say, so my comments were restricted to opinions on consumer advocacy and Due Diligence in selecting the contractor to provide your Insured Storm Damage Remediation Work.

Out of all of the posts made in that thread, the only ones that did not get edited out by the Forum Administration were the ones that I made.

Check out:
www.illinoisconstructionlawblog.com/2009/05/articles/new-suit-fridays-5012009 for the ABA write up on the interest in this case.

It is Cook County Case Number, 2009L004438

Just for further clarification, the same company seemingly attempted to Sue the TOPIX Forum itself previously, but that case was finally discharged from what I read.

googling "slapp" reveals quickly how SLAPP lawsuits are unsuccessful. Apparently the plaintiff in these lawsuits didn't do their homework.

I wouldn't be at all surprised to see the "tables turned" some day soon and the defendants in these cases countersuing, and winning.

The first amendment to the US Constitution guarantees free speech, i.e., prohibits censorship. All one has to do is to tell the truth ("the facts, NOTHING but the facts"), and we Americans have NOTHING to fear.

On HADD there is quite a bit on SLAPP suites. Seems some people can wrong you and you dare not speak up. Many years ago one of our local reporters ran an article that is on this board  called Buy a new Home, Don't Sue and Shut Up. That about says it. What has happened to our right of free speech. That now comes with a price, literally.
Anyone who is wronged should speak up and let others know, educate them, make them aware.
Several posters on the Implode board board were banned for "bickering" HUH??
I looked back at their postings and just saw people that were passionate about their opinions and yes  their opinions differed.
I do not understand the bickering. Same thing  happened on City-data as we well know. . We know C-D does have many that are in the real estate area. I-E  forum does as well but many there are on the builder forum are of course builders. 2 of those banned are activists for consumers. There you have it.
